Mis handling of recieved payments, fraudulent foreclosure practices

In november US Bank Home Mortgage took over my account via refinancing I did on my house. From the very first month with this company nothing has ever been right since.

In now 2 instances I have recieved a letter stating that my mortgage is in review for foreclosure.in the first instance when I recieved the letter they claimed my account was 3 months overdue. We had sent those 3 payments via western union. Unfortunately at the time US bank called us on it we had not saved the prior 2 reciepts, and our daughter destroyed the last reciept. We called western union to have them attempt to verify via other information whether or not the payment had been recieved by US Bank. During that time I was contacted by US bank loss & mitigation services and per those conversations we worked out a forebearance. Western Union 6 months later continues to be "researching" the matter. With no way of proving we actually made the payments, and no way of coming up with an additional $3000 to cover the prior 3 payments we had no other choice.

After the forebearance we had decided to not use Western Union any longer due to apparent problems with confirming payments which had been made longer than 3 weeks earlier. Apparently after 3 weeks whatever system holds all the tracking information is dumped to another system. At that point a simple lookup can be made but a call must be made to the bank the check was issued from to confirm whether or not it had been cashed. Western Union claims this is the "reasearching" that is going on.

When making our next mortgage payment, US Bank REFUSED to accept any other form of payment except for wire transfer via Western Union. We highly objected to this due to past problems, and the US Bank Customer service rep assured us it would work. We continued to object and finally she agreed to be stay on the phone with us at the western union location to confirm that she had in fact recieved the payment. With western union payments typically only take 15 mins to arrive. She confirmed that payment and went on.

The next 3 months we continued to make payments via Western Union, however this time being far more secure with our reciepts, and each time calling US Bank to confirm payment.

Now just days before our 5th mortgage payment is due since the forebearance we recieve yet another letter that our account is under review for foreclosure. And once again US Bank claims our account is 3 months overdue. And even more horrid, we recieve a letter dated 7/13, and US Bank claims our house will officially go into foreclosure on 08/08. Kinda trimmming on the required by law 30 day notice eh? Not to mention we didn't recieve it until 07/30. That's not even the first time they've given us this little notice, our prior notification gave us roughly a week to either pay or lose our house.

Quite frankly I don't find any of this coincidental in the slightest. I believe this is direct action on they're part to not only steal cash money from us, but also an attempt to eventually cause us no other recourse but to declare bankruptcy or foreclose on our house. It is a simple fact with today's realestate market there is a great financial incentive to the lenders to have houses foreclosed on. As these homes could easily be sold for quite a bit more than the amount of the loan.

Furthermore while I have no proof to believe Western Union is implicit in any of this, I now question the insistance of US Bank to utilize them as a payment method, and to then deliberatly mislead us as to the state of our account until such a time that it becomes far more difficult to verify funds sent via Western Union.

I know I'm not alone on this. At least a dozen other people I know all in my area with US Bank home loans are having the exact same issues. This is systematic, and criminal on the part of US Bank. They not only directly steal your payments, then force higher debt on you via the forebearance, but then turn around and do it all over again until they eventually steal your house.

If your a current customer RUN! If your not a customer, DON'T EVER BECOME ONE!
