MoneyTree Mortgage ripoff FRAUD MISREPRESENTATION

I was contacted by moneytree mortgage, loan agent nigel, and was told i had been approved for a loan to purchase a home for up to $150,000. At the time i knew i wanted to purchase a home, but was not sure which one. I wanted to buy the home i was currently renting. Nigel told me i just needed to get the amount locked in and i could take my time in deciding.

He instructed me to send $300.00 for a application fee which would be returned to me upon closing. He stated the amount would be returned in full. I checked the bbb and found nothing negative on the company. The date was january 3. He instructed me that the money could be directly withdrawn from my account at which time i ask that it be done in two increments. The first being $100.00 and the second $200.00 thirty days later. He agreed and stated this would be no problem. He assured me he just needed to have some sort of commitment so he could "lock" in my loan.

He also said their company was set up to assist hard working people as myself who had just had a bad break in life with a divorce or some other situation that had left them in a situation they did not choose to be in. I work very hard and make decent money & currently am paying more in rent that i could own a home for. So as stupid as i thought i wasnt i agree. But, he did not withdraw 100 dollars, he withdrew the entire amount. This caused my account to be overdrawn and i was charged several dollars in isf fees from the bank not to mention the charges each company the check "bounced" on charging as well.

I immediately contacted moneytree and spoke to someone who identified himself as the supervisor. I explained how the money was taken out in a manner i had not agreed to and he stated that he would immediately fix the error. I was told to go online and pull up their website with a special password which he gave me.

Upon entering this site i would be able to pull up my laundry list which would give me a list of all the documents they needed to complete my loan. The sooner i could get them these documents the sooner we could close the loan. Well, i did exactly as instructed. I sent the documents. I was then sent a email from a female who instructed me she had been placed over my account & if i didn't send in information needed soon my account would be closed and placed inactive.

I resent this lady a email informing her this information had already been sent and my acount would not be placed inactive. I wanted exactly what i was promised and i expected to hear from them real soon to set up the closing date. I never heard a word and each email i sent following was returned with no known address. I tried calling and always got a busy type signal which was obvious the phone was off the hook.

I then contacted national information and got all the numbers they had listed for moneytree mortgage which she gave me. I called each and every number, everyday, five to six times per day and not once did i get a answer. The phone just rang and rang. Now these people have all my personnal financial information to include two years of tax information, bank statements, etc. All information one does not just readily give out.

But i did keep copies of each document sent. One such document is for my signature giving them permission to withdraw the money. This particular document i did not return, but the money was drawn out anyway.in fact, the money was withdrawn before i even downloaded the form.

I want to know exactly what i have to do to pursue this. I want my money, in fact i want everything i am entitled to from this fraudulent place for all the suffering i have went through since january. I had checks that bounced because of their dishonesty and since that time have lost the chance to buy a home for my girls and i. Help, i need some guidance.
