My babysitter was driving my 4 year old son home from school when she got into a car accident. She was on the road when a driver, insured by AAA Motor Club, was crossing from private parking lot to private parking lot. Since he was crossing traffic and he had a stop sign she had the right of way. She tried to avoid his car but struck his rear end as she was trying to steer away from him. They called the police, he admitted it was his fault and he got the ticket.
Well, I called AAA trying to get the claims process started, they would not process anything until they could speak to their insured. Fine, I can deal with that and I rented a car on my own. He told me I should call my own insurance company and file a claim. I told him that I only had liability coverage and that it would not be covered, they were responsible anyway and he needed to reach his insured. He also said they would only cover $25.00 per day if they were at fault. Well my car was (I say WAS because it was totalled) a mini-van and I certainly can't fit my family into a shoebox so I had to rent a van. My insurance agent told me to get the State Farm rate of $37.99 and I was able to get that.
Anyhow, they called and said they would only cover the car for 75% because of comparative negligence. I tried to argue they need to put me in the same position I was before their insured hit me and he refused to budge.
I sent them a fax this morning stating that if I was not fully reimbursed that I would file with the Illinois Insurance Department and with small claims court.
One thing that really irritates me is that we have built in car seats for 2 of the kids and the 3rd seat is portable. I paid an extra $650.00 so I could have that built in car seats and they refuse to talk about adding that to the value of the car. I am really out three car seats, not the one portable seat. My agent told me by law they have to replace the one seat, he was not sure about the other two.
