Litton Loan Litton Loan Dismissed From Connecticut Class Action

Breaking news. This is to inform you all that on April 1 Litton was DISMISSED as a defendant in the Hanson v. Ocwen class action lawsuit in Hartford, Connecticut.

The dismissal came about in part because during the MDL Panel arguments in Florida on March 23rd, Litton's lawyers argued that since none of the other 10 class action lawsuits against Ocwen had named Litton as a defendant, it was unfair to transfer Litton to Chicago or California along with Ocwen and Moss Codilis. Litton asked the MDL to sever / cut Litton from the MDL cases and keep Litton in Hartford fighting my lawyers as a separate case. This would have resulted in my lawyers fighting two cases: the main, Ocwen, MDL case somewhere out of Connecticut, and a smaller, Litton action in Hartford.

Also, Litton tried to pull a fast one on us. After making me a generous settlement offer to enable Litton get out and avoid being entangled in the MDL process (which can break many defendants), Litton got mad when I would not jump at the offer (which would have done nada, zippo, zero for the rest of you) and decided to file motions to strike our complaint, on the grounds that we had failed to comply with the district court's discovery orders. This was not true, but we became worried that a court already burdened by the sheer complexity and ferosity of the Hanson v. Ocwen case, just might act to dismiss Litton and sock us with thousands of dollars in devastating sanctions (which I would personally have to pay, and God knows I have spent a fortune already on these lawsuits).

So, between a rock and a hard place, and having had a comparatively lukewarm response to my direct and vicarious requests for affidavits of abuse from Litton victims during the past six months (I got only 8), my lawyers decided that the best thing to do was to avoid giving the court any chance to impose crippling sanctions on us and so cut Litton lose... This was a very agonizing, but necessary, decision to make, and my lawyer made the call on APRIL FOOL'S DAY.

But do not despair, yet! Lieff Cabraser out of California is investigating Litton's practices and will likely wind up suing Litton in the months ahead. Plus, you have the Southeast Legal class action lawsuit chugging along in Tennessee.

The legal battle is far from over. My one lawyer is still fighting mortgage servicing fraud just as hard as before. We will still continue to explore ways to bring exposure and justice to these corporate miscreants and to restore excitement to the American Dream. We believe that God is working His purpose out in this matter and that He will give us the victory. We can see a time in our lifetime when predatory servicers will be as welcome on Wall Street as Nazis are welcome in a synagogue today.

Thank you to all who sent in affidavits and emails, and to all who continue to post here and elsewhere online about the nightmare of predatory mortgage servicing. Hopefully, in the days ahead, we will be able to post more encouraging news. So, that's the scoop FOR TODAY!

PS: NOTE: The Hanson v. Ocwen Class Action Lawsuit itself has NOT been dismissed. The Hanson v. Connecticut Class action Lawsuit itself has NOT been ordered transferred out of state [yet]. The MDL Panel has NOT yet issued any ruling! Only ONE [Litton] of the 19 [Ocwen and Moss Codilis] defendants in the Connecticut class action has been voluntarily dismissed from the case and the case and the $1.5 billion amount of money being sought is in all other respects intact. Watch this space!
