Made an erroneous debit of $400.93 from my account. Due to this my account is now negative $322.52

Previously, ever since October that is, due to a change in employers, I have been a month behind in my payments to Triad. This is due to the fact that my paydays are different. I have informed them of this verbally as well as in writing. I have told them that I am trying to get back on track but it will take a while, that they are NOT the only BILL that I have that is late due to my situation.

So now, If I am a day late on my payments, the calls start. I get a call the 9th, the day after my due date. They say I am late; contractually I am not, until the 18th, I tell them I have sent a check, give them the check number, and then they tell me it could take up to 3 weeks for it to process (?).

Then the next day, and the day after that, and the day after, EVERYDAY they call. I no longer answer the phone UNLESS I know who it is.

The constant harassment, that this company, and its employees know no bounds.

It reached a new low last week:

I worked overtime over the holidays; I planned to pay 2 payments in one month to get back on track. I set up a check by phone for the 3rd and the 17th thru Triad Customer Service employee Sammy Hudson,

January 3rd went off without a hitch.

On the 16th of January, I spoke with Sammy Hudson a Triad Customer Service employee, and stated that I needed to change the date of my Check by Phone debit from the 17th to the 30th. This was due to the fact the check I was expecting was not coming until the 30th of January. He stated that was fine and I thanked him.

On the 21st of January, I just returned home from work at approx 745 AM and logged into my bank account to check to see what I had left for the following week. After staring in horror at my statement, I saw that they did indeed debit my account for $400.93 when I informed them NOT to. With the checks that were covered by my bank came thru, minus the $30.00 NSF/Overdraft charges I was at this time negative $56.00, and I wanted answers.

I called Triad Financial Corporation around 800 AM, on January 21st, and spoke to the Triad Customer Service employee that originally set up the Check by Phone and who I called on the 16th to changed the date from the 17th to the 30th; Triad Customer Service employee Sammy Hudson. I informed him of the error. He stated that the dates were listed on the account as being changed form the 17th to the 30th. He was unsure what had happened.

I was told by Mr. Hudson to Fax a copy of my bank statement to provide proof of the $400.93 debit and any NSF/Overdraft charges. The fax was to be: Attention: Kenebra Wilcott the Triad Customer Service supervisor who handles these errors.

After trying to attempt to fax the documents NUMEROUS times I realized that I was given an incorrect fax number by Mr. Hudson and after several attempts to contact him to get a valid fax number all I was able to reach was an answering machine.

After not being able to get into contact with Mr. Hudson I spent approximately 4 to 5 FRANTIC hours speaking with numerous customer service representatives trying to find a fax number that would get this incident resolved by getting the documents into the hands of Mrs. Kenebra Wilcott.

You must understand time was critical in this situation; I had an electricity bill to pay on the 23rd, just 2 days away. And with negative funds in my account would mean my family would be in a cold dark house.

Finally, at approximately 100 PM, I reached Mr. Hudson. He stated he was in meetings all morning. I asked him to check if the documents that I had faxed have been received. I also told him that I had to use another fax number because the one that he gave me was incorrect. After putting me on hold for a few moments, he stated that he has not received any documents from me. He then said to me that he just realized that the fax number that he had given to me earlier had 1 incorrect digit; he apologized for the inconvenience, and gave me the correct number.

Mr. Hudson also gives me Mrs. Kenebra Wilcott extension and states that I am to call her in about an hour because they were going to lunch.

It is at this time I sent another fax. And did what I was doing all morning, waiting.

I spoke with Kenebra Wilcott at approx 200 PM. I was calling to confirm if she had received the faxed documents from me. She stated that she had not due to that mornings meeting she did not have the time. She stated that she will need to investigate the incident before a decision is made to credit the $400.93, plus any NSF/Overdraft charges, to my account, at the time the NFS/Overdraft charge was 30.00.

On Thursday, January 22 at approximately 0800 AM, I spoke with Kenebra Wilcott again, informing her that I would be faxing an updated bank statement with NEW NFS/Overdraft fees totaling 150.00 that they will need to pay. And that I need this credited to my bank account no later that Friday the 23rd. She stated that they do not redeposit, that the check would be mailed. I told her that this is unacceptable. She stated that was their policy.

I then sent the fax along with a cover letter stating that if my account is not credited by Friday, the 23rd of January, my power will be disconnected. That I live in a mobile home and my stove and furnace are electric. With no electricity I will not have a way to cook food for my two children and that I will have not have ANY heat when the temperature has been a constant 20 to 30 degrees at night and 40 to 50 degrees during the day.

And if the sum of $550.93 is not credited to my account by Friday I will have no other choice but to take legal action against you for the return all monies erroneously debited from my account and an additional cost for the inconvenience that I and my family have suffered due to your mistake.

Kenebra Wilcott, and Triad Financial Corporation, did not care that my children would go cold and hungry. That I do not have money for food for my children, for them to get school lunches for the following week.

The same day, January 22 Triad Financial Corporation calls and wanted to inform me that I am 14 days past due.

This was the point I just snapped. I told the operator that I was on the phone all day yesterday trying to get back the money that the basically stole form me. I asked the woman do you people not have any lines on communication? She then said hold on LET ME READ THE NOTES on your account.

She states that that check, the refund of the money debited from my account, will be mailed. She wanted to know when they could expect my next payment.

I could not speak, the unmitigated GALL that this company has!!!
