In 1993, I was severely injured in a car accident requiring me to have back surgery and a fusion done to my lower spine. This accident ended up going to trial because the insurance company did not want to settle. This accident happened in Texas and ended up going to a 4 day trial in May, 1998 in the District Court of Tarrant County (#17-153459-94).

In Texas' archaic form of civil justice you cannot mention the word insurance in any form of the trial. The Insurance (Farmers) Agent's attorney planted enough bunny trails to make it look like the person in front of me caused the accident. To make a long story short, the vehicle in front stopped suddenly in a school crossing zone after a child ran out in front of him, I stopped suddenly without hitting him, and the car behind me obviously floored it because it broke the seat in my car and I ended up in ER. The man in front of me ended up going to Doctor as well, as he hit his head on the back of the window in his truck.

The reason I am writing this letter is I am still amazed. What was left out of the trial was the fact that my original adjuster was Wayne Ogle @ Farmers Insurance.in 1995, I ran in a bitter campaign for an open City Council seat against him. It was reassigned, but kept in the same office. It is quite obvious to me, that is why they would never settle and banked on the fact that we could never bring the word insurance up in a trial.

Now here it is 5 years later after the trail; 9 years after a major surgery that implanted a metal brace in my back, and 10 years total after the accident in which someone admitted on the stand that she was negligent and caused the accident and I am left with nothing. Nothing to pay the ongoing medical bills, nothing to seek the ongoing care I so desperately need, nothing to pay over 10 years in lost wages. Tell me where is the justice? Shouldn't the insurance company be liable now that the cover-up has been revealed? I am at the end of my ropes and need advice.
