Satterfield Organization has a Money Back Guarantee (less a $500 service fee) if they fail to modify a loan. They failed, but we never got our refund.
Part 10 of our Service Agreement with Satterfield Organization says: "if we fail to perform, we commit to return your entire service charge, minus a $500 fee for our time and services."
We signed this agreement on February 3rd. During this time, Satterfield has not fulfilled their part of the agreement, even though they state in part 5 that the possibility of your lender not approving the loan modification is "rare".
Over a period of two and a half months, Satterfield had no problems cashing the post-dated checks meant to cover their service fees. However, during the months that followed the final payment, we repeatedly asked for a update on the status of our loan modification and received a response several days later stating that our modification is in "review".
In mid-October, we sent a formal request for a refund. We received a response stating that the refund could take up to thirty days to process. Thirty days later, their continued response has been that the refund is in the "review process".
Despite Satterfield's blatant failure to modify our loan, they have refused to honor the terms of their own Service Agreement. Part 3 states that "the Service Agreement shall remain in effect until cancelled by any party of the agreement". This would most definitely include us, the payers of the loan and their service fees.
This situation is completely unacceptable, and Satterfield Organization is in violation of the very Service Agreement that they have authored. Although part 6 of the Service Agreement claims they have years of expertise and are allegedly honored to have earned your business, it would seem that these claims are just as outrageous as their Money Back Guarantee. Satterfields practices are at best shady, and at worst outright fraudulent. They have absolutely failed to be worthy of [our] trust and confidence.
In summary, we request that Satterfield honor their Service Agreement and refund us the fees due to us as per the Service Agreement, namely $1,995.00 ($2,495.00 total fees minus their $500.00 non-refundable fee).
Since the above details and the explicit language of the Service Agreement have made it abundantly clear that we are entitled to a refund, we request that the Satterfield Organization honors their Money Back Guarantee and refund us $1,995.00 ($2,495.00 total fees minus their $500.00 non-refundable fee).
