America's Servicing Turned down for Make Home Affordable Modification - Reason - Loss Mitigation "determined" we (the owner) did not occupy premises

I would like to report America's Servicing Company (better known as Wells Fargo Bank).in December of I applied for a "Make Home Affordable Program."

I was set up on a payment plan of aprox. $1,800. On May America's Servicing decided they were finally ready to work on a modification. My paperwork was sent in in December. On May of I was told that they needed proof that I lived in my home. They needed utility bills. My wife pays the majority of bills online. My wife printed out the bills but this would not suffice. America's Servicing... Wanted the "real" bills... First they wanted a phone bill, and a light bill. A week later, I received a call saying that I sent a bill from last year and they needed a current bill. Okay, fine, I understand. I sent a new updated bill. They wanted to see a cable bill. I was also told that I had a deadline of that next day to get my bill over to them. After producting everything they asked for, it was not enough.

The following week was June 1 and time to make my modified payment. This was on a Monday. I guess they decided to reject my loan modification on Friday, but no one told me. They waited until I attempted to make my payment to inform me I was declined. My payment was not accepted and I was told I was declined because the loss mitigator "determined" that the home was not owner occupied. Amazing, this loss mitigator "determined" this. No investigation, just a determination. I'm assuming by their crystal ball that I did not live at this home.

I also own another home which is in foreclosure but do not live there. No one has ever come to my home to see if I in fact live there. My wife and I have lived in this home for aprox. 6 years. My neighbors could have been questioned. Anyone that knows us, knows where we live.

On June 24, while getting ready for work and my wife was watering the grass of our home (where the loss mitigator "determined" was not owner occupied). Someone came up and taped on door "trustees sale." My wife had just sat down for a minute and was going back outside to water the other side of the lawn, when she saw the paperwork taped. They never even rang the doorbell.

The next day, papers arrived in the mail that our home would be sold on July 13. Also, in the mail, a letter from American's Servicing saying that they are selling our home because, when the loss mitigator was checking our documents, I had a tax statement with a different address (the other home that I owned) and that they needed utility bills and we sent one bill that was from 2009. Therefore, it was determined that my wife and I do not reside in the home.

What a nightmare, especially since it was "determined" that I did not live in my house. So basically it's been a fariy tale that I have been living in my home for all these years.

I did contact National Reserve and made a complaint against Wells Fargo.

What an excellent place to be able to go to for help. They immediately called Wells Fargo. A representative called my phone once. I tried repeatedly to call her back and she never responded.in the letter that I received today, the "representative" informed me that she was writing this letter because she was "asked to respond to a complaint filed by the Office of the Comptroller of the Currency."

So basically to even get a little attention I had to go over there heads.

Also, when the complaint was made, the answer that America's Servicing gave was to make the one phone call, and pretend that they never received a call back and that day get a package ready and fed exed the next day to my home. What was the package. She wanted us to "re-apply and do the documents all over again."

Is this right. Is this what the Make Home Affordable Program is? We were approved in December. You gave us a payment and we made that payment until May. We were never later.

Shame on America's Servicing, actually shame on Wells Fargo because this is the big bank hiding.instead of helping Americans, they are "determining" who they will help.

I wonder how many people are being denied for some of the "weakest" reasons.
