The purpose of this letter is to officially complain about the unfair practices of Chicago Title and Insurance Company, which I believe may actually be a violation of the law. I have made Chicago Title aware of the problems in this case, and they have denied my claim.in fact, in my conversation with Mr. Rick Meurer, he introduced the topic of litigation without any prompting from me.in denying the claim, he very tersely stated that they were immovable in this matter and were "prepared to defend their position in court." Furthermore, in a letter to me he stated, "We suggest you count your blessings and move on to more important things in life."

Let me tell you how the problem was caused by the inaction of Chicago Title. My problem is with the funding of my loan on Thursday, October 27. Please note that my wife and I signed the papers and provided our checks at Chicago Title on Thursday, October 26, but did not actually get the deed recorded, and therefore were not able to take possession of the house until Monday, October 30. My objection is that I had to pay for several things from October 26 - 30 without benefit of the use of the house; including but not limited to, Homeowner Association dues, interest, principal, insurance, and taxes.in addition to Rick Meurer, I also talked to Sandy Clark and Alan Costley on 11/14/00 and 12/21/00, respectively.

I have a letter from the First Bank of Arizona, which states that they had funded the loan and that the [Chicago] Title Officer acknowledged she was in a position to close and record, on October 27 at 13:30 hours. The only excuse from Chicago Title was that it was raining and the courier couldn't pick up the check from the bank. I paid for courier service to expedite this transaction which was clearly not used in the manner expected. HOW LAME - IT WAS RAINING! The excuses are not acceptable.

About 11 months ago, I spoke to Patty in the Arizona Department of Insurance about the problem I was having with Chicago Title & Insurance Company. Pursuant to that conversation, she recommended that I try to call the V.P. Of Chicago Title, William Greene, Esq., at (312) 223-2581 and (800) 621-1919 est. 2581, because frankly they probably wouldn't do anything about it. When I called the number I learned that he had just been replaced by Eilene Van Roeyene, Esq, who had been in the position of handling these types of matters for the State of Illinois. She told me that she would have taken Chicago Title to court right away if she had been treated that way. Despite my e-mails, I never received the promised responses from her e-mail address: [email protected]

I also contacted the Better Business Bureau of Northern Arizona, who said they had an unsatisfactory rating, but never did anything to help me. The Dispute Resolution Manager was Farzi Chapman and all they did was forward my complaint to Chicago Title and their response back to me. Frankly, I see no purpose in what they do.

In the past 11 months there has been no progress so I am determined to file this report in hopes that others may beware. Please investigate this matter fully. If there has been any wrongdoing, I will cooperate in any prosecution of this company.

I will follow up with what I think they owe me.
