Credit card ripoff scam

On October 10 I received a yellow card in the mail stating that I could get a credit card with a $4000.00 limit. I needed to call and activate the card. Upon calling I set it up so that the money $241.99 was to not be taken out of my account until October 29th as the money would not be in there until then. The employee also stated that I would receive my card the same week the money was sent through which I found out later it takes 6 to 8 weeks. She told me that I would need to call back in on Friday as they could not set it up that far in advance.

On Friday I spent 6 hours trying to get through to this company, most of the time on hold. First thing Saturday morning I called again and spoke to an employee by the name of Vincent. He informed me that they had already sent the transaction to my bank.

I told him that the money would not be there and wanted to know who was going to pay the NSF of $30.00. He stated that it clearly was on my account that the transaction could not be sent through until October 29th. He then gave me the fax number and the name of the Customer Service Manager who is Agnus. He said to fax the bank statement with the NSF on it with a letter explaining what happened and she would take care of it, or at least review it.

On October 20th while conducting other business at my bank, I found out that they had again tried to send the transaction through and I now had another NSF of $40.00. I contacted the company again. I spoke with an Eliana this time whom I might add was extremely rude. She stated after I explained what had happened again, that her company was not going to give me $70.00 and that I had made a verbal agreement. She also stated that it clearly stated that this was not to go through until October 29th.

I then told her that her company had made a verbal agreement which she just confirmed and they had not honored their end of the agreement. I asked to speak to Agnus and was told that she was gone for the day. I then asked to speak to another manager and was told they were all gone to lunch. I asked when they would be back and she told me that was none of my business. She also stated that I fax everything over to Agnus.

On October 25th I faxed the bank statement, along with a detailed letter to Agnus attention. On October 26th I called just as a follow-up to make sure she had recieved it and to see if we could resolve the situation.

This time the employee told me that Agnus was to busy to talk to anymone and that was why they paid her. She then started to scream at me that I would never see my $70.00 and I needed to get over it. She stated that the money had been in the bank and I had stopped payment. I told her the money was not in there and never had been that was why they did not get it. She also stated that it clearly said not to send through until October 29th but that it was my problem not hers.

I then told her that I was going to file a complaint with the Attorney Generals office. She asked me to hold. I thought to get Agnus to I could speak to her. When she came back on she said "Agnus said that is fine if you want to file a complaint but could you wait until Tuesday because she is probably going to quit on Monday." At that point I ended the conversation as it became very obvious that this company is not on the up and up and there was no reason to continue to argue with them.

I called my bank to stop payment on Monday which is October 29th the date that this transaction was suppose to go through. I really need some one to point me in the right direction to stop this company from doing this to other people. I like most people live pay check to pay check. I am disabled and live on a very limited income. $70.00 is alot of money to me. Please advise and help.
