Dear Fellow Victims of Ocwen:

I have been reading from the sidelines all the comments and countercomments posted in this wonderful forum offered by the usacomplaints.com. I have read ALL the recent reports, including those by Robin, Marlene, David, Bob, Cynthia, Ann, and others.

First to Cynthia: I just received your package in the mail, and am reviewing it. Your strategy is a brilliant one and I am ready to help you fight off Ocwen (and its big brothers) as you battle them in the Florida federal court. Secondly, again to Cynthia (regarding your post in the preceeding report): every resident of the USA is protected by the First Amendment to speak their mind, and that includes borrowers victimized by Ocwen. And that includes the right to voice concern about the apparently slow pace of the Hanson v. Ocwen proceedings which have the potential to affect hundreds of thousands of consumers.

I, myself, in a sworn statement submitted to the Judge hearing this case, have expressed frustration at the pace of this lawsuit. I gave my reasons for my views, not the least of which were my 13 years experience of the rate at which federal cases typically proceed, as a lawyer in federal courts.

Robin, Marlene, Bob, Ann and others, watching from the sidelines, have also apparently picked up this theme. As you know firsthand, Cynthia, and as dozens of others have shared with me in confidence, while this case has been marking time, folk are losing their homes. And to dispel any doubt as to how diligent or lazy my lawyers has been in fighting the case, I have posted below the entire PACER report of the case to date.

I do NOT endorse or criticize any approach by anyone. I do respect EVERYONE who sympathizes with the victimization of Ocwen's borrowers, and especially appreciate those who are voicing their opinions (even if I do not necessarily agree with everything they say). I certainly DO NOT oppose victims either coming up to Hartford, Connecticut in person and/or sending letters to the Court to urge the case be given the priority it may deserve as a putative class action. See Federal Rules of Civil Procedure, Section 23 (a): "A case filed as a class action SHALL be determined as soon as practical."

What remains practical, of course, is entrusted to the sound discretion of the court. I simply voice my opinion here that NORMALLY, a preliminary injunction motion is prioritized, as is a class action, and I know that a lawsuit filed in Tennessee in June (one full year after Hanson v. Ocwen) as a class action against Litton Loan, is already being briefed on class certification, and a preliminary injunction has already been entered in that case. Now that is Speedy Gonzales or the Road Runner! I wish we would proceed with Tasmanian Devil speed!

Anyway, I have much, much, more to say. I am APOLITICAL (non-partisan), but I have read much in the press and on the Net. I do NOT believe in deliberately antagonizing a federal judge (they are powerful enough even to order Nixon to turn over tapes or fine Clinton for lying & there, I bashed Republicans and Democrats equally). But I do know, because I have received copies of such correspondence, that Ocwen victims complaints to State officials, federal regulatory officials, and even in some instances to Congrespersons, have not YET accomplished much.

So to that extent I disagree with David. At the same time, I agree with David that perhaps additional, non-judicial, steps may be warranted to supplement the lawsuit efforts. It took lawsuits, press publicity, and public outcrys to get Fairbanks to start a house-cleaning. It took class action lawsuits to get Washington Mutual to settle three days ago. It took class action lawsuits to get Household Finance Int'l to pay out $484 million. It took class action lawsuits to force Citigroup to cough up $275 million. It took class action lawsuits to get First Alliance to vomit $60 million. It took a lawsuit by NY AG Spitzer to get Delta Funding to spit out $2.1 million.

Look at it this way: can each American on his or her own fight Bin Laden or Al Qaeda? Don't we rely on collective self-defense to wage war against foreign terrorists? Why should we each indidivually fight a domestic financial terrorist? There have been and will be casualties along the way (foreclosures, forebearances, etc.) but in the end, I hope to GOD (and God is not a dirty word to me, but actually the only hope I & in whom apparently so many folk have placed their trust & am looking to. I am not looking to the Judge for resolution of this case; I am not looking to Ocwen for resolution of this case; I am not looking to my lawyer for resolution of this case; I am not looking to President Bush or the FTC Commissioner for resolution of this case; I am looking to God to work a miracle, and if I offend anyone by saying so publicly, I do not apologize for paying tribute to the power through whom I own my existence and intellect. Enough said!
