Breach of contract and doing business in bad faith

About October of I contacted Litton Loan Servicing, because the fixed rate was going to roll to am ARM. Litton had taken the Morgage from a company that folded. I explained that I had in writing, for the other company, a document signed by the last company agent, stating that just before the ARM went into affect, they would refinane the loan to a 30 year fixed, without any new fees. A copy of the document was sent to Litton Loan andone of their agents told me that the document had nothing to do with them, I was then told that I would be notified of the new payment and interest.in December I received a statement tht showed the interest rate had jumped from 7.2% to 9.2%, increasing the monthly payment by about $600.00 per month. I made hundreds of calls to Litton Loan about my situation and and could not make the increase payment. I advised Litton Loan that I could continue with the current payment but not the increase. The Litton Loan agent advised that if i could not make a complete payment with the increase, not to make a partial payment. While trying to work with Litton Loan in December My wife was told that she had Breast Cancer. Many hundreds of calls to Litton Loan trying to work with them on this situation, I would go direct to a voice mail system that was full or if you did speak to a real person, you had to explain the complete situation again and would not get any answers, you could never talk to the same person twice. They always demanded payment and i would explain again. Because I would not get any answers or help, I contacted a company that advertised specialized in modifications and litigation, to assist in a modification. I consistantly was notified that Litton Loan was overrun with cases and that they could not find or was not in their fill, needed papers. I always sent any papers they said they did not have, that i already had sent several times. After a few months, June I received a document in the mail. It was a Modification agreement to be signed and the details of a 3 month trial period. I immediately signed and dated the document and returned the document in the self addressed envelope they provided. I sent Western Union Moneygram to Litton Loan, on June 30, the first payment. I then called Litton Loan, and after several trys, I finally talked to an agent and verified that they had received the payment, I then sent the second payment, by Western Union, on July 30 to Litton Loan. I called to verify that the payment had been received, the agent advise the payment had been received but the first payment was sent back because they could not except Western Union payment. I went to Western Union and pickup the money and bought a certified check and sent it Federal Express next day back to Litton. I checked Fed Ex on line to track the payment and it was received, On August 30, I sent a certified check for the third payment to Litton Loan, by Federal Express, I checked on line and also made a phone call to make sure they had received the package. I then received the second payment (Western Unoin) back and I immediately turned it in a certified check and returned it by Fed Ex. I inquired as to how to make the next payment and as to when I would receive the information about the modification. I was told that I would be contacted before the next payment was due. I had not heard any thing from Litton Loan Servicing, so I called to make sure I had all the information to continue the payments and have no problems, after a few calls i finally was able to talk to a real person and was told that in July, they sent a new modification document, I advised them that i had never received any paper work after the original modification document. That i had complied with the original document and had made all 3 trail payments. I advised that I had talked with many of their agents over the last 3 months and no one had ever mentioned any change. A week later I received a packet in the mail from Litton Loan Servicing. There was a modification document dated July but the envelope is postmarked in September. The new modification stated that the new payment was more than what the payment would have been with the ARM. I contacted the company that was helping with the modification, and ask them to contact Litton Loan and assist with the original modification. This company advised that they would have to resubmit all the paper work and try for a new modification. I then contacted a california law center that was referred to me, they said that it should not be a problem and requested that Litton Loan Servicing set up a modification. We have tried everything to complete and work with Litton Loan and have had them postpone sale dates 3 times, I just received word from the law center that Litton Loan's investers have rejected the modification and would only talk about a payment plan with as much cash as possible up front and then would advise the terms of the payment plan. I then received word from the law center that they had set a new sale date for January 4.

Litton Loan has breached the original Modification and continually lose and misplace paperwork to delay processing and completion of these Modification.
