I was hoping to have a more constructive discussion with you than I have had with your colleagues - both of whom I have recorded not only being rude and shouting, but also not listening to their client on telephone calls. As I have stated previously, it was as if they were reading a prepared script, and they were unable to answer clarification questions as soon as they were knocked off the script.
I am not blaming GFP for not finding finance. I am simply stating that GFP has not undertaken the services it undertook to perform under the engagement letter between us. I know both your colleagues have denied knowledge of the engagement letter (I have recorded both of them state that), but you cannot make the same claim, as it was indeed you who signed it on behalf of GFP.
The fact that I can produce a signed engagement letter and made a payment of $10,000 to you, in accordance with that letter, just proves that your statement about me not wishing to engage you fully is something that you have only just made up to try to excuse GFP's non-engagement in this project. Do you want me to email the engagement letter that we both signed?
And I am not off base. I have been trying to enforce the contract between us as encapsulated in the engagement letter. But since the dates for that project (which we were both aware of when we entered into that agreement) have now passed, and you/GFP have not commenced the services as set out in that engagement letter, then I am now seeking a refund of the initial fee paid to you.
And for the avoidance of any doubt, I have read the engagement letter very carefully, and with my attorneys, and in no place does it state that I should not make contact with any parties introduced to me by your organisation. My direct contact with Guggenheim, even if I had been able to contact GFP at the time, is therefore not a breach of contract, and if you had put that as a term in your engagement letter I would have known not to sign it because there was clearly something wrong with your organisation's lack of transparency.
Please read the engagement letter between us, and if you think that GFP has actually started providing any of the services set out in that agreement, please point that out to me. If not, then please agree to make a refund of my initial fee. I have recorded Andrew making so many absurd statements about the fee and about the services, that I am sure it would be simpler for your organisation to refund the fee than to have to hear all of this in an open court.
So as you can see they are a group of individuals that are completely unprofessional and lack any and all experience in the world of structured finance.
