Con, Scam, Fraud, Ripoff

The reason none of HRP's employees or affliates have posted here is cos they/we found out the day before Thanksgiving that the company was closing its doors and screwing all customers. Affliates only found out cos another affliate discovered what was going on and sent us all emails. We are all scrambling to assist our clients. Most of us were legitimate, licensed LO's who worked on a referral basis when we had a client that needed their services. ANd they seemed to be doing a great job for the last nine months I worked with them.
Now, however, we have been informed that they closed their doors and are essentially abandoning 1000 files. These are all pre-paid files. (We were told they had filed an Advance fee agreement with CA. Brian Sudur, one of the owners is just basically saying— "Oh well, tough luck" and painting himself as the victim here, saying he has lost his investment in the company— boo-hoo! Meanwhile he has already opened another company (Capital Mitigation)— and is playing "let's make a deal" with HRP affiliates saying he will complete their residential loan mod files (instead of abandoning them) if they send him new commercial loan mod deals. Brian says HRP is bankrupt, and various affiliates/employees say they have not been paid for two months. But do the math— at $1400-1600 per file— and he/HRP is walking away from a rumored 1000 files— that is rounded off around $2million /-. And that is just incomplete files— not the money he/they made on other files. How does a company making that kind of money go bankrupt?
Brian has told me they are not refunding any money despite a guarantee HRP gave to clients. HRP will also not be paying for the files to be completed by another company. We are being contacted by other Loan Mod companies and they are saying if we pay them MORE FEES, they will complete HRP's deals for us. (We are being told that sort of thing is our only option.) I personally think that sounds like another scam. No way do I feel safe/comfortable referring such a possibility to my clients with a company I know nothing about.
We were sent an email on 11/3 assuring us that HRP was doing GREAT— that the Attorney General of CA had said they were doing business in just the right way— and that the new CA regulation would not impact how they did business, cos they were doing all the right things already. And they continued to accept files and fees. AND, if what affiliates are telling me is true— they have known for months they were in trouble— cos they haven't been paying people. And I have been told they haven't worked on files for at least two weeks— since 11/15 approximately— and that suggests to me they knew they were in trouble when they sent us the Assurance email on 11/3. That to me constitutes FRAUD.
I will make sure my clients get their money back even if it is out of my pocket— but the fact is HRP is deliberately screwing a lot of people who cannot afford to be screwed— who are already in desperate situations— and I do not think they should get away with it. To me, their actions are criminal.
