I once worked for H&R Block and thought the world of them. They let you file the family members for no charge. They was honest and seemed to care about their clients.in January we went to Walmart in Crawfordsville to file our taxes like we usually did since prior years. It was a new lady from the year before but we decided to go ahead and do it so we could get it filed and get the money we needed to get kids the stuff they needed for that winter. We got to the question of "Whether the kids was his or mine or if they qualified for EIC or as a dependent", in our situation I had 3 kids and he had one that was biologically his out of the 3. We told the lady that the oldest 2 was not his children and that we are not married so we knew we would not get EIC for them but he could claim them and me as dependents since he had made and paid over 60% of our support, and the children's father can not claim them at all. She filed and finished up and we found out we was getting a great amount back. She put our card in and said it should be on in like an hour. We went and sat at the subway in Walmart to wait and then after the hour called the card and all the money was there, it was great we could finally get bills paid off for awhile and get kids stuff they needed for winter and fix our van and all that great stuff.
Well all the above seems great. 4 months prior to filing our 2008 taxes we get a letter from IRS we was being audited. Not happy we contacted the local H&R Block, of course there was no answer, and few days later still no call back. For about a month I called and finally got an answer and talked to a lady. She told us that we would have to come in. I then called IRS to let them know we was going in to see what was wrong and they let me know that we needed to amend the taxes and take the kids off. I called my aunt who has been working with the H&R Block in Lebanon and she had me read out the sections to her. Threw talking to her we found out the women had put my children as his biological children instead of "other". So we met with the lady at the H&R Block in Crawfordsville. We amended our 2007 taxes and filed the "Peace of Mind" claim that we had bought to cover any mistakes.
Remind you that when you buy the "Peace of Mind" it is suppose to cover their mistakes. Peace of Mind states " The Peace of Mind Extended Service Plan offered by H&R Block Service, Inc. Is available only at participating Block offices at the time your return is completed, but no later than October 31 of the year of the return due date. The Plan is separate from, and in addition to, Block's Standard Guarantee that pays penalty and interest resulting from error in tax preparation." Hmmm this is first paragraph of the Peace of Mind so when you pay the $30.00 for this you should be fully covered by them. Now here is more of the Peace of Mind Guarantee, " The Plan is effective when paid for and signed by you and, cannot be transferred by you to others. Subject to the exceptions noted below, the Plan provides you with the following benefits with respect to the individual federal and any individual state or local returns prepared and paid for on the date of this agreement." " If your return is audited, Block WILL provide you with a qualified person (but not an attorney) to represent you before the tax authority should such tax authority question the accuracy of your return." hmmm so they should be by your side to help you threw this issue because "THEY" made the mistake." If you owe additional taxes as a result of an error in tax preparation and the error is discovered by you, your representative or a tax authority, during the period of 3 years from filing deadlines for such returns, not including extensions, Block will pay you for such taxes up to cumulative total of $5,000.00 for all such returns, subject to the terms and conditions detailed below." The rest of this paragraph talks about the 3 year limit. Then says "In some cases, the correction of a specific error will involve changes on multiple returns, including State or Local tax returns, which may result in an overpayment on one return and a balance due on another.in such cases, the overpayment and balance due will be netted in determining the amount Block will pay for additional taxes owed as result of correction of the error. Block assumes no responsibility for payment of additional taxes to a tax authority. You are responsible for providing payment of additional taxes to the tax authority." According to this you will be paid $5,000 and they will pay off taxes for their mistakes or am I wrong hmmm.
So to get back to what happened to us. We filed the "Peace of Mind". We also filed our 2008 taxes. While doing this we had another issue, our son that was born on July 8 and my other 3 kids had been taken in August by the CPS so who could claim them. We knew he could not claim the 2 oldest since biologically they are not his and since that is case they have to be in home for 12 months. But the younger 2 are biologically his we knew that he could claim the daughter she had been in home for 7 months but the baby was born and was 3 weeks old when CPS took them, we asked the manager what to do, You would think if they wasn't sure that they would pick up phone and call IRS to find out what to do, instead he made the comment " Just pay the $30.00 for the Peace of Mind and if he is not suppose to be on there then you are covered." I should have then just picked up our stuff and left and went to my aunt in Lebanon but I figured he knew what he was doing. So about 3 weeks later we got our $5,000.00 for the Peace of Mind for the mistake on the 2007 taxes. Also we had not received our 2008 tax money we found out that it had been frozen. We went to the office to make sure we did not have to pay what we owed for the mistake out of that money. He told us he was not sure that we should figure it up and put it in bank and all that. I then called the Peace of Mind because I was concerned and I am a worrier and didn't want this to come back on us. I talked to a lady and another lady so I talked to like total of 3 people even one from the main H&R Block out of Indianapolis on this money and they all told me "The money is yours to spend the rest will be taken care of too. The $5,000 is yours for the time you have had to take and to make sure you will stay a devoted customer." Another words they was paying us off to keep us with them.
Several months later we get letter from IRS saying we was being audited for the 2008 now because of our son. We had to prove he could be claimed I sent birth certificate and all the papers they asked for. We called H&R Block and set up a meeting because we was being pretty much harassed by IRS because he owed money that still was not paid and also state was sending sheriff letters threatening jail. So today is November 27. We are still worried. We went to meet the lady and she did not show we waited 45 minutes and she still did not show, we called them back only to hear we needed to call local office to make appointment which we did and they did not show, we have been still getting letters and we still have the possibility of him going to jail. His 2008 is still froze and he hasn't got them. We called a lawyer for advice on what to do because HR Block has not done anything they promised, he told us it would be cheaper for us to call Peace of Mind and see what to do than for him to write the letter. We just do not know what to do we are coming up to another year of taxes and the 2008 tax years are still not fixed. Remind you what was quoted above on the Peace of Mind it states that they will pay and also HR Block has standard guarantee which is quoted in the above. What do we do they are really messing us up and with neither of us able to work right now because of health and he has had to file disability I do not want to end up like the lady in Lafayette, We need help and bad!!!
