I just recently opened my credit union account about 2 weeks ago. I applied for a loan online through JK Marketing about 3 days ago. I was approved for 200.00 loan which was deposited into my credit union account today. But when i checked my account i only has 85.02 in there. When I called the bank to find out why, they said that an ACH from Centurion/Loan Point USA did a draft from my account for 320.00. Granted I did have a loan with this company about a year and a half ago but it was with my old bank account at a different bank.
Is this legal for a payday loan company to phish the internet for new account information and then draft the account for an unpaid loan? I know I didn't pay the loan because is was in so much financial distress that i couldn't afford to pay it off when due but I don't feel it's fair that when you apply for loan on the web from another company these people are able to retrieve you new account info and draft that account with out you know it. Aren't they suppose to draft from account that loan was originated? I need to know what I can do about this. Thank you.
