Good afternoon. As you know I am disabled. I am having a problem with Crockett Natinal Bank. I took out a cattle loan. For $10,000.00 One year and six months ago. The Loan was coming due and the cattle market was down, so I did not want to sell my herd which was "Organic" for the cattle prices had dropped in the stock market downturn. I called on phone and spoke To Kim Walls my banker weeks before loan was due on cattle. At this time the Note due on cattle was $8,000.00. The note had been renewed on time before for 6 months. I paid $2,000.00 down and renewed the note for six months. We spoke of using the house that came from my Dad as collateral in a total cash out refinance option which would have included the cattle loan. We spoke of cutting of some of my farm 56 acres into a small amount cut out to re-fi. This would not have worked for the one year rule on home loans? Would not been able to use the house that dad gave me for note re-fi which was held up on sisters court case.
At that time Kim Walls said not to worry if all I needed was to put cattle payment on note she could do that if I put $2,000.00 down and put on one year payment. Then could do re-fi with my dads house when that happened. I then called Kim before note was due on cattle. "All of the phone calls were made on cell phone so record of day and time would be available". To tell her that cattle loan was due and need to put on payments. We spoke a few times then some time latter she said every thing was ok, she would put cattle on one year note and would need another $2,000.00 down. I said ok take the money from my Agg account. She took the $2,000.00 from my account at this time making the balance $6,000.00 and was going to call me back with monthly payments for one year.
With in a few days, I had an problem with my disability. My 18 year old disability dog, to old to swim, went into my pond and was drowning. I went into water to get him. When I entered the Ice Cold Water My back, legs and arms went into Massive muscular cramps. I almost downed in the pond, sucked down nasty pond water in my lungs and was very sick near death for weeks. My cell phone was in my pocket and wet from water would not work anymore. I was not able to travel or much else for some time. I tried to get new phone but had trouble getting to store. I had to hire a older gentleman to help me around the house go get my mail, store etc. Also I had set up auto-payments form computer to make cattle loan, $275.00 every two weeks from Wells Fargo. Two payment had been sent and received by Crockett Bank. I was able to get a Wi-fi phone to try to fix cell phone trouble. It would not work most of time. Sam the man hired to get my mail brought me my mail and in mail was two papers from post office for legal letter from Crocket Bank. I phoned her on that Monday, And she informed me that the bank had my cattle had been picked up on Saturday and was going to be sold on that Monday. I was to sick to go and buy them back at sale barn. The sale brought more than the note was for.
I have questions, One I was not given time to respond to letters, for Kim Laws had mislead me making me think their was no trouble with the cattle note And I was responding in good faith and sending in payments well above amount to payoff in a year.
Question number two, The cattle were Organic and organic cattle sell big premium over regular cattle. They sold my cattle with out any type of notification that the cattle better than normal cattle and would have brought 35% greater price than normal cattle. On a year on year organic is an extra $5,000.00 per year or $1,000.00 per head.
The thing that top's it off is that they have now filed on my credit report make the situation grave for I need to Re-fi on my dads house. Over the next 7 years This will cost me Thousands of Dollars.
Can you help me with this? If so what do we need to do? If not do you know of someone that could help me. Do I have standing on the American with disability side. A non-disabled person does not have medical breakdowns that cause them to loose gaps of time. Thank you for your time.
