I applied for a payday loan with pay day yes in March.
I had a due date set up for them to take the payment out of my account. Unfortunatley, they didnt take the payment out of my account on that exact date, but at a later date which caused my account to be overdrawn. I then received harrassing emails from them stating that i had to repay the loan amount or they would apply late fees and later would forward my account to an outside agency that will demand payment in full (which included late fees and any other fees that applied).
I have worked in collections for almost 10years and I knew this was unlawful. I explained to them the reason why its past due is because they didnt take it out of my account on the date they specified. Their response was so we drafted your account on that monday and the funds were not available. I knew this wasnt true and I demanded to speak to a supervisor which i was advised that one was not available to assist me.
They continued on a monthly basis to draft funds from my account without my consent which later resulted in my account being over drawn by $1200.00 which I later had to close.
I received a call from a company called PDM at my place of employment and spoke to a rep named Annie, she said she was representing pay day yes in a loan that i recieved and never paid it back, she advised me that i can pay $215 and the balance would be paid in full. I explained to her that i didnt have that amount of money at this moment and i am in the process of trying to maintain my household and take care of my family! Her response was "Good luck to you." and she hung up in my face. I called back spoke to a supervisor named Sammy and he advised me that if i paid the amount by the end of the month then it will be taken care of! I told him i dont have it and when i get it i will pay! He said that would stop the harrasing phone calls. I told him dont call me at my place of employment and he said we can call anywhere we want.
This company is a rip off and i would advise that anyone that needs a payday loan for whatever reason to not use this company they use unlawful tactics.
