I pay bills electronically from my bank using ACH transfers. Recently I scheduled a payment on 1/9 to go out on the next day 1/10 to Citibank. So the credit card company has the payment in hand that day yet the payment isn't posted to my account until 1/13 (Tuesday). The payment was declared late since it was due on 1/12. After 2 emails with customer service they would NOT waive the $39 late fee plus interest for the month (I normally pay in full).
It seems to be an unfair business practice if the declared due date is really 3-5 days earlier than the declared due date. It is geared toward stiffing the consumer with a charge because they sit on posting the payment to the account.
I did check the online version of the card member agreement and it only refers to the due date, noting about paying earlier.
