We are in NY, never got contacted by Unifund or their attorney about a collection of a credit card debt till we got a cetified letter in the mail from the Marshalls office that a judgment for a Earnings Witholding Order was granted in Feb (we just got the EWO this January)
It states the Employer will be notifed on 2/14
We sent a certifed letter to the attorney asking for validation of debt to be provided to us via certified mail, return receipt.
We are also exploring getting a Claim of Exemption and Financial Statement form sent to us and this is where we are hitting the roadblock
The attorney's office, County Clerk, and County Attorney's office all say the Marshal's office has to supply us with 3 copies of the above forms to file.
When we call the Marshal's office, they say we don't know what we are talking about.
Per Employee Instructions Form WG-003, it states to call or write the 'levying officer' for the forms... Is this valid to do in New York State?
