Yesterday I logged into my bank account and to his horror discovered that he had a negative balance of 5800. I had no idea what happened. I called the bank and all they could tell us that there was a tax levy or garnishment applied to the accounts and gave us a phone number for the law firm Pressler and Pressler in New Jersey (973) 753-5121.
I never received any notification from them that they were sueing or anything. Nothing certified in writing, absolutely nothing! It's not even on my credit report or anything. I called them on Jan 24 to find out what was going on. They said it was a debt from ATT from about 8or 9 years ago. They said they served me a court suppena in 2006 at some address in New York and my physical description was 160 lbs with brown hair. Now the funny part is I have lived in Florida since Aug and am 330 lbs with balding no hair. I have never been 160 lbs!!! I asked if they had any certified letter return receipts with my signature, they have none. So I was never served any documents and never received any letters. How can they do this??? It is not legal. I want proof from them that they contacted me or served me, which they can not provide and will not provide. How can they get a judgement against my bank accounts with out ever sending me a notification, certified letter or suppeona in person??? Is there a way to go after them for faulty practice. They took my child support, my rent, everything... With no notification at all! My account is all screwed up now and frozen.
I understand the Attorney General of NJ has already started an investigation against them, I hope she succeeds.
Any lawyer looking to take a class action lawsuit against these filth of humanity will have a ton of people to represent and I hope they win big. Please contact me if you need me to be added to the pile. I want JUSTICE!
