Ripoff company didn't honor or enforce the contract we signed consumer fraud ripoff

When we financed our home loan through Universal American Mortgage Company/Lennar Homes we felt as though we had made the best choice at the time.

The escrow funds for our pool were set up with specific instructions to be dispursed by UAMC via a joint check written to us and Blue Haven Pools at specific intervals as the project proceded.

My wife and I are shocked at Gail Bell and Pat Westbrook's total disregard of these instructions and appalled at the behavior exhibited by the staff at UAMC. I found it necessary to inform Gail Bell that if I needed to have our attorney call her and explain the dispursement instructions that she signed, I would.

I was told by Gail Bell that we might forge Blue Haven's signatures to the checks and not pay Blue Haven. With this kind of mentality Gail Bell's skills might be found to be useful at some more menial task than interfacing with valued customers.

UAMC loaned us close to a quarter of a million dollars based on our proven responsibility in managing our finances and our professional lives.

For Ms. Bell to suggest that we might engage in criminal activity is the height of unprofessional conduct. Ms. Bell did manage to choke out some sort of apology after I emailed her but became incensed when I asked her how much experience she had handling these types of loans.

She said that it is UAMC's policy to never send the check directly to the customer. And I again reminded Ms. Bell that I expected the instructions for dispursement of funds to be followed.

I also asked her why she didn't have any knowledge of these instructions and was told that it is common practice for her name to be forged on these type of documents. And also to give the contractor the benefit of the doubt that the work is done according to the contract.

Forgery at Universal American Mortgage company is common practice?

So far our pool is stalled again (it has now been seven months and still no pool) as Blue Haven made another severe miscalculation in the construction of one of our fountains at the gunite stage.

This along with not following the city's instructions has caused us much grief and has not allowed the construction of our pool to progress along in a workmanlike manner.

There does seem to be a lot of employees at Blue Haven who actually do have criminal records. First our salesman Mike Miloser and the last project manager sent to us Davin Self. This we found out after we began having trouble with the construction of our pool.

We would like to know that our funds are being handled in a professional manner by UAMC and North American Title Companyfor an equal rate but went with UAMC because of the "builders incentives".

These "builders incentives" don't give UAMC the right to treat us like the criminals we have been dealing with at Blue Haven Pools. Currently we have no idea how much the first check was written for or where it was sent.

Please send us that information. And please set us up with someone professional to work with at UAMC.

Neither Pat Westbrook nor Gail Bell have shown us that they merit the positions afforded them by UAMC.
