I filed a claim with Washington Mutal in April, within 24 hours of discovering a fradulent charge on my debit card. I've done everything I was suppose to do after that. I too, received the infamous letter.'you did not submit enough evidence to substantiate your claim'. I was told by a very rude claims specialist to investigate the charge on my own with the merchant, because they were not going to contact the merchant without more evidence. I was not there when the charge occurred, so of course I have very little 'evidence' to support my claim. The law states that the bank can ask for a statement of facts, but this does not hinder the bank from proceeding with their investigation. The law also states that the 'burden of proof is on the bank to determine the authorization'. They did neithe and are not in compliance with the law. I contacted the Office of Comptroller of Currencey which regulates banks, who then forwarded my claim to the appropriate agency, OTC, to further investigate with the bank. I truly believe WAMU is just lazy, short staffed, or just do not care about its customers. If anyone else knows of any othe recourses victims can take to recover our funds, please assist others. My internet research reveals many customers that have the same issue with WAMU, perhaps its time to file a class action law suit??
