Refuses to issue refund for Fraud charges / Identity Theft Victim new york

I'm an identity theft victim and filed a report with HSBC for fraudulent Internet charges on my credit card. HSBC refuses to give me a refund on the fraudulent Internet charges and this is there response!

"Since your credit card was not reported lost or stolen at the time of the transaction and the merchant has provided us with information that supports the charge, we consider this matter resolved. We are debiting your account $19.95 and $29.95 to reverse the credit that we previously issued."

As soon as I got my credit card bill and noticed fraudulent charges I reported my card lost, and what really makes me mad is the merchant just sent a letter saying the dispute this and gave HSBC an ip address 3000 miles from my home. Saying it was authorized.

DO NOT GET AN HSBC card. Get a real credit card like American Express. The same charges appeared on my AMEX and AMEX told me that they have had thousands of complaints about this Internet merchant and AMEX is pulling there card from them. AMEX gave me all my money back.

So if Amex can do it why the h*ll can't HSBC do it?
