David, Morgan & Associates - Peter Brown, US National Bank - 1clickcash.com
Had my Social Security number & really old address. Threatening Arrest, 3 counts of criminal charges for an alleged paydayloan of $320.00 from 2005 California

I recieved a call at my work number (on my personal line), originally was a lady with thick accent, she asked for me by full name and when I said, "this is she", she said "one moment, please" and then a man came on (also very thick accent). He again asked for me by full name and again I said it was me and could I help him.

He proceeded to introduce himself as Peter Brown (I find that a little hard to believe since he had a very thick Indian and/or South Asian accent... I would know, my parents are from India... I've yet to meet an Indian person with a name like Peter Brown!) He said he was calling from "David, Morgan & Associates", that they were a firm representing "US National Bank". He proceeded to read off my Social Security number (which is what made me even stay on the phone) and an address which was like almost 8 years old (i.E. It wasn't even my address at the time he claimed I had this loan). Also, he had the name of a family member he claimed had co-signed for me (which they never have co-signed anything for me) and that they would sue them too if I didn't cooperate with them.

He asked me to give him my attorney's name and phone number so that they could send the information to them. I told him I don't have an attorney and to send the documentation directly to me. He told that wouldn't be possible since they'd already sent me certified letters to the address on his file (which I pointed out hasn't been my address for more than 7 years so I couldn't have received any letters there). Also, I asked him how it was possible he had signed certified receipts when I never signed for any such letters. He said they were signed by someone else (wouldn't give me the name on the receipt) and that it wasn't their problem I didn't get the letters.

He also claimed they sent me 12 or 13 e-mails, which I never received either. He said that because of this they were no longer allowed to send me anything, and could only send it directly to my attorney. I again repeated I didn't have an attorney, to which he replied that one would be appointed to me. I asked if the court would appoint one and which court were the papers filed with. To this, he said, "no, not the court but their firm would appoint one to me". I told him that made no sense, because if they were representing the loan company, how could they also represent me? I was becoming very suspicious at this point...

I then asked him to repeat his name and the name of firm and asked him to give me exact date, name of loan company and amount. He again told me all this stuff was sent in 12 or 13 e-mails they'd sent in the past two months that they've been "investigating" my case. I continued to question the validity of his claim after he read off a "bank account" number he said the loan had been disbursed to. He said the name of the bank was "Commerce Bank". I told him I've never heard of that bank and never had an account with them. He basically called me a liar and that I was just saying whatever to get out of paying my debt. He said at this point I was being sued for $1,234, which included interest and penalties.

This conversation went on for a few more minutes like this. He got more and more rude and threatening, the more I questioned him. He said I would be arrested since I wasn't being very cooperative, and that they would call my boss and tell him all about this situation. I told him that I didn't believe that he was legitimate because if he was he would know that debt collectors cannot do that and he would be willing to send me the documentation.

I told him to never call my place of employment again or I would file a police report. I have not received any calls yet today... But after reading a lot of other peoples situation I've decided not to wait for them to call me again. I'm going ahead filing complaints with the Attorney General's office and the FTC.
