I am 26 yrs old i purchased the 2002 dodge neon in 2005 my mother was primary on the loan and i was the cosigner the finance dept at the dealership did this in order to get a better intrest rate. My mother paid my car payment for the first 6 months as i was a full time student and living on my own. I was working but only as a waitress.in dec i moved back in with my mother and in march she filed chapter 13 bankruptcy. The neon was not entered into the chap 13 as i was out of school and working full time i took over the payments. This is all in the bankruptcy paper work. Cf stopped sending statements and wouldnt allow me to view the acct online currently i am 69 days past due.in jan they sent a letter titled as a notice of default and a right to cure (bankruptcy) stating i was behind 150.96 for dec and 160.57 for jan with a total amt due 2/13 in the amount of 311.53. I made good with this payment actually making a pmt of 312. Last night 6/11/08 at 2am a repo agent (the nicest one out there to my beliefs) knocked on my door and asked for the keys to my car stating he had an order to repo my car. The information he provided me and my mother didn't make much sense to us since the orders to repo came from hsbc and not cf the pmt amount was 477 and my pmts are 161.99 but the vin # matched so he took my car-he did allow me to get my stuff out though - 1st thing this morning i called cf and was told i was behind 69 days. I asked about the notice was told to quit yelling or they would disconect the call which they did so my mom called back as i called this hsbc-who btw has no records of ever having my acct-i admit to being behind but i am willing to make good on what i owe. Cf cant tell me why the repo orders have my lender as hsbc and all this incorect info. I have been fighting with them since 9/06 about getting my statements for my records they say when i speak to them its against fed law when my mother speaks with them they say its company policy. I have asked for the documentaion proving this as i cant find it online the say they cant send it to me. They say they cant send anything because of the bankruptcy. I need help i dont know what to do or what i can do this company is horrible it lies cheats and steals from hard working people. There are alot of complaints against this company. When is enough going to be enough
