ALG Capital #xx77 Mortgage loan funded different than what signed. Loan NOTE and Truth -in-lending missing. Mission Hills Calabasas California...
I had the very same experience except my loan dragged on for 5 monthes and after I signed the doc, s the title company called me and said would I need to sign a few more papers and faxed me 21 new pages that I had never seen before... These new pages had a much higher interest rate and were missing from my originals package given to me by the notary during the documents signing...
I told the Title Co that there must be some mistake because the interest rate was not 5.625% that I had locked in like the good faith estimate I had signed with the notary. The Title Co then said they had my signature on papers with an interest rate of 6.450% to which I replied NO WAY!!! So the Title Co then faxed the papers in question. I was in shock to see my poorly forged signature on the higher interest loan documents. I then asked the Title person to look at my signature on any other papers she might have that didnt have anything to do with higher interest. She then replied the signatures were not even close and for me to send her the right to cancellation paper signed right away.
I was told by Josehp Nguyen at Alg Capital that with my 800 credit score there would be no points or loan origination fees from the very begining.
Then I said my present loan was 6.25% and would never get a new loan at a higher interest rate even if it had no loan origination fee to get $42,000.00 cash back... To which she replied, this new loan that I was saying was forged, was going to pay ALG Capital $21,000.00 in loan fees and my cash back would be less than 1/2 of what my "Good Faith Estimate" I had signed with the notary and my family present...
Needless to say I am going to pursue all legal channels available to me starting with my local District Attorney to make ammends for the 5 monthes of stress and lies not to mention many late payments I was told not to make month after month because I was told the loan docs were being sent over to ALG Capital and would be on their way to me for signing and the payment for that month was not necessary. Then days later after avoiding my phone calls I was told the docs must have been misplaced and were going to have to be sent over again which seemed to take another month, and then the same story all over again.
I caught on after the second late payment charge to which I was told by Joseph Nguyen (when I could ever reach him) that ALG Capital would take care of any and all late charges that I had paid due to the loan doc papers being misplaced month after month...
I can no longer reach Michael (Joseph, s Manager) or Joseph at that Calabasas Office because the recording tells me that phone# is no longer in service, and they are surely not trying to get a hold of me since loan papers were forged with my signature I guess?
