Charges overdraft fees when account is not overdrawn

Well, I am quite upset, Wachovia bank charged me for $70 in overdraft fees and my account was still in the positive even after the fees. How is it possible to be "overdrawn" and have money left in your account after they charge you for overdraft fees? I keep pretty good track of my purchases and I check my checkbook register with their website to make sure I don't miss anything.

I can admit that we did have a problem with our finances until about 2 months ago due to us having 3 house payments. My husbands job moved us 2 times in less than a year so we got stuck with 2 mortgages and a rent payment for a while. We were able to sell 1 house and rent out the other and have since been able to keep our account in good standing as I am pretty good about keeping track of our finances now that we dont have those 2 mortgages hanging over our heads.

Anyway, after trying to get gas and finding out my check card had been declined I came home and checked my account balance only to find that the 49.05 that should be in my account isn't there and that I am actually 20.95 overdrawn. After researching my account activity I found the problem.

On the morning of 3/10 my balance was $175.25. I had 3 purchases posted to my account on 3/10 ($92.96, $6.00, and $5.83) for a total of $104.79. This left $70.46 in my account to which I was charged $70.00 in overdraft fees 0n 3/10. On 3/11 we had a credit direct deposited into our account for $57.71 which shows up as processing but should bring my account balance to $128.17. I had 2 debits ($63.00 and $6.00) for a total of $69.00 also show up dated 3/11 and are tagged as processing and 1 check card hold for $10.12 which hasn't even begun to process on my account which should leave my account balance at $49.05.

However, Wachovia charged me an overdraft fee 0f $70.00 on 3/10 which meant that my account was reduced to $0.46. Then they charged me for the 2 transactions dated 3/11 and only after they charged me for those did they enter my direct deposit (also dated 3/11) as recieved. Thus, my account is now overdrawn by $20.95 instead of having a balance of $49.05.

I called the bank and was told that the debits that show up as 3/11 were actually accounted for on 3/10 (if they were accounted for on 3/10 why are they dated 3/11 on my account) and was told to have a nice day and hung up on. I called back and was told that I would be transferred to someone who might be able to help me and again I was hung up on. I called a third time and was told that I could not get the fee reversed even though my account was not in the negative even after they took their fees.

This is absolutely ridiculous, I have been robbed of my money and noone wants to help. I even printed the transaction history off their website that shows how things were charged to my account. When I told them this I was told that how it shows up online is not necessarily how they are charged to my account. I was told that I should keep better track of my finances but according to my checkbook and their website, I should have $49.05 in my account.

I feel that I should be refunded my $70.00 and I think that it might be good business for Wachovia to not charge you an overdraft before they even account for a purchase on your account in their system.

How can I be overdrawn if I had $70.46 in my account? I don't see how that is even possible. If the money wasn't there then why did my checkbook and their website say it was? Personally, it seems like a big load of crap, they took my money and don't even want to try to rectify it.
