We have had similar problems with having our mortgage check returned to us because they received our payment late without the late fee included in the payment— even though we mailed it on time and didn't think that a late fee was necessary.
This reaks havoc in your life because you think that you've made your mortgage payment only to find out that they sent it back to you and now with an additional penalty fee. And when you don't get it returned to you until a week before your next mortgate payment is due, what an eye opener! Talk about a panic attack.
I'm not sure what changed, but our payments are now going to a different branch location and instead of having our check returned to us, they simply send us a notice that we owe them a late fee. Of course, we shouldn't even be recieving the late fee but it's better than having my check returned!!!
We would be very interested to see what would happen with a class action suite. If my memory serves correctly, I thought that Homeside was already in a class action a few years ago.
