I have read and responded to many of your complaints regarding Telecheck and their affiliates. I have experienced what many of you folks complain about, but in my case the problems went on for two years. I tried to settle the situation by writing letters to Telecheck over that two year period, unfortunately, with no success. I was placed in the uncomfortable position of having no other choice but to file a lawsuit.
The case is called Holmes v. Telecheck, in the Middle district of Tennessee. If you or your attorney look the case up on Westlaw you will see the judges recent ruling that largely denies Telechecks motion for summary judgment.
I know how horrible this company can be and the hard hearted, strident approach they take to destroy and humiliate people while they themselves are the purveyors of porn (look up shared global, a wholly owned subsidiary of Telecheck Services Inc.in yahoo, the cache version for those details). That is why Im offering to be a witness for any of you who reach the point of litigation with regard to alleged violations of the FCRA, FDCPA or Unfair and Deceptive Trade Practices.
We have got to stick together so the merchants can verify for themselves whether the customers at their registers who are being rejected and humiliated are a bad risk or not. Let the merchants sit in the courtroom and watch how Telecheck treats their customers and decide if this is a partnership they want to partake in. My trial starts in Nashville, February 19.
