Sims has a reputation for suing on behalf of CACV and CACH, both of Colorado. He does not follow fair practices expected in court procedures, and this is the best way to trip him up. You MUST point these out to the Judge for action. Always be aware of the time limits the court allows in response, the statute of limitations for suing (Michigan is 6 years).
Make him produce ALL original documents that validate the debt and EVERY charge added to arrive at the balance he is currently seeking to collect. He will not settle, so don't waste your time trying. You must beat him in court at his own game, which requires attention to detail on your part or he will trip you up. I would also suggest that you report Sims to the Michigan Attorney General and any debt collector agency you can find out he is a member of. This will get him investigated and disciplined yet again for his lack of ethics. He routinely violates the Federal Fair Debt Collection Act, and EACH violation can cost him $1,000 in court if you choose to sue him. Sims is a scumbag that runs when confronted with hard facts that go against him. Look up his legal history on PACER. He has been sued several times for fraud. Obviously, public embarrassment and humiliation have no effect on this slime.
