My wife and refinanced in Aug.'07.in March we found out we could protest the violations and wrote to Randall Mortgage in Las Vegas/Henderson Nevada. Bay Capital Corp. Was the lender. No response from Randall within required 20 to 60 business day RESPA mandates.
Bay Capital acquired by Clear Choice Financial sent certified letters to all companies involved, no response. Bay Capital's letter returned, no forwarding address.
A few weeks ago had an audit company actually perform detailed survey and found close to a dozen RESPA/HUD/Regulations Z/X violations. Attempting to find a consumer affairs attorney to handle this contingency case in US District Court in Reno but attorney could actually reside in another State.
Not sure if there is an existing class action suit with above companies. I know Bay Capital is in court with many suits. Feel Randall Mortgage is more at fault than anyone but all companies involved share in violations since they agreed to get involved either by servicing or otherwise.
