Bank Of America Didn't You Know? Only In The Good Ole US of A Can The Big Guns Get Away

We purchased a car from Ed Volyes in 1998. The motor blew up (with me in it) in May of 1999. A Certified mechanic stated that the motor had been previously "burned" and refurbished, which possible caused the fire. I was not injured, but notified the dealership, and refused payment to AIB until the dealership would talk to us or try to make some arrangements to either assist with the repair, give us a replacement or give us some time to have the repaires done. Our short as sweet answer was, make the payments or lose the car. It's already loss, burned up, un-driveable.

In September of 1999 the car was repossed. The only information we received was from the repo company that we had 10 days to claim our belongs that we left in the car. No other communication period, until March when we received a summons from the county to appear in court in May of which we did, with our attorney.

A settlement (which we thought) was made and we were ordered to pay $100.00 per month to American Investment Bank, and send payments to a particular address, which we did, consistantly, and have cancelled checks and verifiable money order reciepts to prove it. On July 29 a default judgement was filed in magistrate court against us (which we received absolutely no notice of).

We received a letter from Cavalry Portfolio Services on March 18 stating that AIB had sold the loan to Cavalry SPV I, LLC and referred for collection, indicating that the amount we owed was $1700.00 more than the original judgement. We placed a call to AIB and a corrected amount was noted. We continued to send the $100.00 per month, until both my husband and I loss our jobs, our home, and our credit went to hell in a hand basket.

Husband found another job, we were in financial recovery and then on July 181 2007 AIB and/or Cavalry filed a garnishment via Bank of America and took our entire savings and checking. We were told on July 20 by a representative from Cavalry that there was nothing they were willing to do to correct any of it as the magistrate judge ruled in their favor and that any and all subsequent deposits would be held by the bank for electronic transfer to ABI/Cavalry. And we wonder how people end up homeless? Because we live in a country where the big guns rule and the little people lose.

We are just hard working people trying to make it and receive fair and just treatment. We never had any intentions of not paying our bills, we did not have the income to do so. This is the second week that my husbands entire paycheck has been garnished, and we are told by not only the courts, but several attorneys that there is nothing that can be done. Boy. Only in the good ole US of A
