I am putting out a request for a lawyer and co-defendants to file a class action suit against Option One Mortgage. If there is anyone out there please contact me immediately. I recently lost my home of 12 years to Option One. It was a prize fish for them as it was valued at $1.1M two years ago in Hawaii but now is about $850K so they wanted it.

Like other victims listed here, I was ripped off of my home by Option One.in April I didn't have enough money in my account (3000 versus 4100 payment) so after 18 straight payments on time my check bounced.

I recently had to pay relocation to a new job and was expecting a check from my employer which they refused to pay until the first week in May. So when Quicken Bill Pay cut the check there was not enough there. Option One waited until the last week in April to tell me. I was unable to pay my mortgage until the first week in May. They wouldn't defer for one week!

The first week in May I had over $12K in my account so I cleared a wire transaction to Option One for April and May. I called Option One to give them the wire transfer and they refused. The representative told me my money was not good to them anymore and they refused a wire transfer. From that point they refused my payments until they declare foreclosure.

I sought refinance but in 2/22/07 they put the property up for auction. I thought by declaring chapter 13 that I could stop it. I claimed disabillity as I broke my hip, diagnosed with Parkinson's disease, had major depressive reaction, and other personal disasters. I stopped the foreclosure until my new attorney told me to refile the chapter 13 which was a "mistake."

I filed to dismiss my pro se 13 and in the two weeks before my attorney filed for 13, Option One submitted affadavit and petition to the court claiming the deed to my property. My attorney admitted she did not pay attention to my email stating the auction had already occurred.

So I am now homeless being forced into foreclosure by Option One and malpractice by my attorney. My choices now are to sue Option One for illegal sale of my home (through letters requesting my insurance coverage and notice that we would resume payments in June, they misled me to believe they were going to stick with me but unknown to me they instead were grabbing my property in the background) and/or trying to buy the property back from Option One as it has been listed by them already. I am also facing eviction now and don't have much time left.
