I had a credit card with Capital One and I missed some minimum payments around the holiday season. My account was closed and a representative from Viking Collection named Ben Drake started calling my home with "life or death" type voice messages about my account.

I called him back and he stated that my account with Capital One was frozen and that I need to either settle the account or pay it full before April 30th. I told him that it would take a few days and that I would pay it off in full. He said that if I didn't pay it off by the 30th, the balance of $1926.46 would get hit with 29% interest and increase by approx $45.

I told him that I would talk to him again in a few days.in the meantime, he wanted me to post date a check & "allow" him to hold it almost 2 weeks before the 30th. Yeah right, he's not going to deposit that check before the end of April if I give it to him? Think again buddy.

After that the fun began, he started harrassing me by calling my job almost everyday. The second time he called, I told him NOT to call my work because it's illegal due to section 805 of the Fair Debt Collection Practices Act (FDCPA). He laughed and chuckled at me right after I told him that! I told my boss that if he called again, she could speak to him.

He called my job the next day and my boss talked to him. He told my boss I never stated to him that he must stop calling me at work and also told my boss he didn't have my home number, even though he called it SEVERAL times. LIAR!!!

So, I called Ben Drake a couple of days later and told him I was sending the check the next day. He told me to overnight it and call to give him the tracking number. I overnighted the full amount on April 26th, knowing Viking woud get it the next day around 3PM. I called Ben Drake later and left the tracking number twice on his voice mail since we left the office.

On Monday, April 30th I called to confirm he got my check. He told me he did BUT my account wasn't closed. Apparently, I still owe him $47.70. I told him how can that be since they got my check on the 27th. He said I didn't get the check there on time. The interest hit already. I told him, "you said I had until the 30th." He said "I never told you that."

Obviously, I got very upset and he said that he would send a bill for the remaining $47. My wife took the phone from me and started firmly telling him that he's wrong. This guy starts yelling at my wife and she hung up on him. I called back but spoke to another person that said my account was closed according to their computers. He also said that Ben Drake is the only person who can handle my account there.

I called again sometime later, got another new person and they said that my check was sent to Capital One already. It's not even aboout the $47 but the whole principle of it. Viking's telling me that I gotta talk to this *sshole again to straighten it out. I called Capital One MANY times to see if they got my check and they put me on hold and connect me to Viking when I SPECIFICALLY tell them not to. I just got the "exciting" new bill in the mail today. What do I do know? Pay it or what? Can someone please help me with this? Thanks.
