Ripoff dishonest thieves with horrible customer service who ruined my credit

I wish I knew about this website before I made the biggest mistake in my life, finacing our home and a rental property with GMAC. Based on the stories I've read it appears everyone is in agreement on how GMAC will stop at nothing when it comes to trying to foreclose on people's houses. I too was in the same boat as many of you however I was able to experience it twice once in March and again in July.

We fell behind in mortgage payments due to me losing my job. We were making partial payments while trying to get back on our feet. Even though GMAC accepted these payments the funds weren't being applied they were sitting in a special fund so when we were 1 payment behind they still were showing us as 2 payments behind. Then we started receiving the threating mail about being in default and foreclosure action that could be taken if the account wasn't brought current. I was in constant contact with GMAC through this whole process and was assured this wouldn't happen because we were making payments and communicating. We finally set up a payment plan and mailed in the agreed upon amount based on a telephone conversation with a Customer Service Rep in the collection department. After mailing in the payment we were served with foreclosure papers and the payment was sent back to us. I immediately contacted the Loss Mitigation department regarding this. They agreed to stop the foreclosure after I informed them about the conversation with their rep. However, there was one catch I would have to pay the attorney fees of approximately $1500 before they would dismiss the action. I was between a rock and a hard place I had no choice but to agree to this or lose my house. Of course, this didn't make our financial situation with GMAC any better. The second time our house went into foreclosure we were a couple days late because you can't call in your mortgage payment when your automatically connected to the Loss Mitigation Dept answering machine. I left a voice message to call me back because I needed to make the agreed upon payment. No call was ever returned so I called again this time I was told I was again in default and they wouldn't accept the payment. I would have to do a loan modification, pay attorney fees again and forward approximately $6000 to stop this foreclosure. I was fortunate I had a good friend who lended me this money. I thought finally I'm current this will never happen again. Oh No! Once GMAC has you they have you and will do whatever, however, and whenever to keep you. We would mail payments which wouldn't post until 2 weeks later when their 1 state away. Then they would post late fees and special charges because of this. Finally, I thought I was getting smart I'll just call my payments in. I would rather pay the $12 fee than all the extra fees. Good Luck everytime I would call I was told they couldn't take my payment the system was updating and I would have to call back later.By the time you finally get through when the system isn't updating your late now you get to pay the late fees and charges and the phone fee. Frustrated with this I came up with what I thought was another brilliant idea make my payments online. Wrong!!! You register and for a few months this works without any mishaps then you start getting login errors and need to contact the Customer Service Dept to reset your account so you can register all over again. Like so many other people you can't get ahold of GMAC. There were many times I waited for over an hour there were also times I couldn't wait and would have to call back later but then the payment was late. We finally realized the only way to get away from GMAC without them trying to take the 50% equity we had in our home was to sell it. Which is what we finally did in October. It doesn't end there they are reporting me as Late 30 days currently still to this day. I disputed the information with GMAC and the Credit Bureaus but they won't change it because they claim their only reporting the last payment as 30 days late. As of March it still is reporting as a current delinquency and the credit bureaus refuse to reinvestigate because of the amount of times I disputed it. But it gets better in the process of disputing this our address was changed in the credit bureaus to an erroneous address with all of our closing documents and year end tax statements mailed to this address. I finally contacted GMAC Voice of the Customer hoping they could resolve the credit inaccuracy, the erroneous address and update our current address. The erroneous address was explained to me as an error when their CSR entered the wrong account number when dealing with another customer. A letter was sent to us admitting this error and that we would be signed up for 12 months of Privacy Guard a credit monitoring service because of this. No information was given as to how to use this so I contacted Privacy Guard who informed me that since GMAC was paying and had enrolled us we would have to talk to them. I've contacted GMAC several times and to this day my calls have not been returned nor have I been able to use this so called service nor has my credit report been corrected.

We have recently looked into refinancing our rental property because since we sold our home we started having problems with this account. Although we are current just last month GMAC reported this account to the credit bureaus as a Collection/Chargeoff account. I called GMAC immediately they corrected it. But just another way to mess with you. Not to mention I tried to make our payment online and the account had to be reset. When I asked the Customer Service Rep why this happens almost every month I was told it was because they were making improvments to the website. Just today I went online to make my payment during my break at work and the same thing happened. I called Customer Service and told them I had to re register again but I didn't have my account number with me at work to complete this process. I was informed they couldn't give me my account number over the phone however they could mail it to me. When I gave them my current address they didn't even have the right address they still had the old address even after their records were supposedly updated. I am so frustrated with this company and would never ever do business with them again. I would be more than willing to participate in a class action suit so those bastards can get what they deserve. I honestly hope GMAC goes under in their Mortgage Lending and other Endeavors. A company like this doesn't deserve to do business they are a disgrace to the American People.
