A Innovative Merchant agent had come in my store trying to provide us with credit card/debit services. The agent kept pushing me to buy there services saying it will be month to month service and no termination fee. So i figured if there is no termination fee why not? Since they had better rate then my existing provider. I already had the machine so they provided us with just the service.
I had to close the store because of financial problems and also my lease was up. I called Innovative Merchant saying that I closed the store and I needed to cancel the service. So I went through the cancellation process. Going through my bank statement later that month I see a $295 fee from Innovative Merchants so i called and ask what this fee was for, they told me its for a termination fee. I told the rep I was on a month to month basis and was promised that I would not have a termination fee. So they told me to fax in a copy of a final bill and a letter stating that we had closed our business down and needed a termination in service. I got right on it and sent it in. I called back in a couple of days making sure they got it and they had reversed the charge. I asked if they reversed the charges and she had told me there is no way to reverse the charges and that the termination fee applies to every customer. I told her that another customer agent told me to send in a final bill and a letter explaining that i closed the store and they would be able to reverse the charges and she said there is no way that is possible and that even though there is no contract there is an agreement saying there is a termination fee. I asked her in the contract it states it is a month to month and the agent that sold me your service made a promise that there will be no termination fee applied and it can be cancelled anytime. She got steamed and blew up on me screaming that it is not a contract it is an agreement. I got pretty steamed at this point and asked for her to explain whats the difference between an agreement and a contract and she just explained it by saying to bad your getting charged the termination fee so I asked to talk to another rep and she said just call back someone else will pick up so I hung up redialed. This is when i encountered a calm nice person where he had explained to me that I just need a second document proving that i closed the store. I thanked him and sent him another final bill showing that I closed the accounts and store. I called back the next day to follow up on my request and spoke to the original rep that told me to send in my final bills his name was "Fredrick" and he said to me "I've done my homework on your business and I called in multiple times to your business and they picked up saying your business name" I explained we had closed and a new tenant was in the building and he told me that our business is still open and when he tried calling again and again they had hung up on them. At this point I was fed up with there lies so I asked him if I can have a conference call with that same number and see if they answer with our business name. He said to me "I dont care if they answer saying they're Jesus" and explained that we did not our business had not closed. He tells me "I did my homework and studied your case for 20 days." So I will be sending in my final tax report saying ive closed the store. I just can't believe he had the nerve to say "I dont care if they answer saying they're Jesus"
