I filed bankruptcy as an individual after serious financial problems and a foreclosure. I had no joint accounts nor any authorized users. A week after filing, I began getting calls from Allied Interstate for one of my adult children. I asked what it was about. They named ExxonMobil. I had an Exxon Mobil account, which was included in bankruptcy; my adult child has never had an account with ExxonMobil.
I said I would take a message and to send a letter about what it was about. They called several times daily. (and are still doing so). Sometimes they ask for other of my adult children.
A bill then arrived, from ExxonMobil, addressed to the person they keep calling. The bill is for my account number, my balance prior to bankruptcy, to my address, but addressed to my adult child.
Additional bills, same account, same balance, same addressee, from GEMoneyBank, and also from Allied Interstate.
Letters were sent to all three, Allied Interstate, ExxonMobil, GEMOney Bank, demanding proof of debt, return receipts required. Signed return receipts from all three have been received. More than 30 days have passed since the letters were sent.
Obviously, no proof of debt has been received. It is not and never was the debt of the person addressed. The phone calls continue. Automated messages are left on my voice mail. Calls are received several times a day. I have informed callers that the debt was mine, included in bankruptcy, and not the debt of the person they are trying to reach, and that they are not to call me.
I have sent my lawyer a log of the calls. They continue to call. What is my next step? Cease and desist letter? Complain to the attorney general? I don't want this affecting my children's credit; it isn't their debt; they are concerned, especially the one the bills and collection notices are addressed to.
