Our mortgage loan was sold almost immediately after we signed on the dotted line from New Century Mortgage to PCFS Mortgage (Provident Bank). We had filed Bankruptcy Chapter 7 because of a serious illness in the family. We did not include PCFS Mortgage in our Bankruptcy. We continued to send our payments as usual. I also noticed I was getting late charges on my payments so the next time a payment was due I included my late fees. Our bankruptcy was discharged in Sept in January all of our payments, money orders and checks were sent back to us from our October, November, December, and January payments with a statement stating our loan was in forclosure and they wanted the full payment of the loan plus the late fees. These were the original payments and dated as such. I contacted our lawyer who in return contacted PCFS Mortgage lawyers. PCFS Mortgage lawyers instructed our lawyer to send in all the payments to them. Which he did. A week later we received all payments back from PCFS stating they would not accept the payments and they were forclosing on our home. This happened over and over again until June which our lawyer instructed us file a Chapter 13 to force them to reaffirm with us. Which we did file a month or 2 later we received noticed they sold our mortgage to LITTON LOAN SERVICES. They never receive any payments I mail to them causing me undue stop payment fees to pay it over the phone as a check by phone transaction which also has a fee attached. Oh yes they do add on those late payment fees and not one person at LITTON would wave those fees even though they gave the excuse that maybe the payments were lost because of the Hurricanes Katrina and Rita. They will not work you even if they are at fault. I recently tried to refinance to get out of this continuous nightmare and found out they are reporting us as late payments on our account even though we paid on time every time and they sent those payments back to us. Which by the way my lawyer and I have all those copies and copies of letters from their lawyers as well. I have proof of this rediculous scam and I would love to sue them for the mental anguish they have put on our family worring about loosing our home when we have a very sick individual to take care of. Also for the bad credit ratign the afflicted us with and for all the phone calls, lawyer fees, bankrupcty costs, and all back late payment fees that were added to our mortgage just so they can forclose on our home. When we went to refinance our home to get out of this nightmare the loan officer was trying to get a hold of PCFS to confirm that they made an error and they really did send our payments back to us and the phone just rings and rings and rings no one answers. I tried calling the phone # that I always used for my complaints and payments and I was instructed to call a 900# which is a 9.99 charge a minute. How do mortgage companies get away with this. I want it stopped and I want it stopped now. I will not be bullied out of my home.
