Wrongful Account Closure, No Refund of Balance, No Customer Service

On August 22 Bank of America elected to close my personal checking account. I was notified via US Mail of the account closure from a Janet Hunter, SCO-Account Closures #20438, Los Angeles Ca.

Upon receipt of the letter, I contacted BofA Account Closures. I was informed that since opening my BofA account (August), I had deposited 2 items that had been returned non sufficient funds (NSF). Further I was told that if in fact the error was that of the payer (vs. Me the payee), I would be able to re-open my account by demonstrating proof of payer error at a local BofA branch.

On September 6 I met with Angela (BofA Employee: 16th Street and Osborn, 85006 BofA branch). At this meeting I submitted documentation from the payer and the payers bank (Bank One) explaining that the 2 items in question were returned in error and that the error was of no fault of my own rather solely the fault of the payers bank (Bank One). This information was forwarded to BofA Account Closure Department by Angela via fax (818.291.8630).

On September 8 I received another letter from Janet Hunter.in this letter Janet explained that my faxed information dated September 6 was reviewed and that BofA had made a decision to end the account relationship. Further Janet explained that I had not been reported to ChexSystem.

On September 12, I contact BofA Account Closure Department. During this call I concede the fact that my account is closed, however I inquire about the funds that were in my account at time of closure (a positive balance of $369.16). I was informed that $60.00 was deducted for "Account Research Fee" (not something I requested nor approved) and the remaining balance of $309.16 had been mailed to me via certified funds. I verified the address BofA had on file as my "mailing address" to be correct. The date of the certified funds issue was said to be September 1 on BofA certified check # 2021297068. Finally I was told that I would need to allow 30 days for which the check to reach me.

On October 1, I contact BofA informing them that I had not received the certified check # 2021297068. I was told that another replacement check would issue. On October 4 I received a letter from Linda Pechous of BofA Customer Service Support, Tampa, Fl. 33622 confirming receipt of my request for stop/new payment of certified funds in the amount of $309.16.

As of November 22 I have not received any funds from Bank of America. I have made several phone calls since the October 4 letter. All of them unsuccessful attempts at collecting the funds owed. I find it reprehensible that a bank can conduct business with such malice. Further, I now face numerous financial challenges as I await funds that have been promised and re-promised to no avail. Should I face these challenges without collecting on the funds owed, I will tenaciously seek for damages. It is unjust for an organization to fraudulently acquire private funds without consequence.

I have all documentation to irrefutably collaborate my account of this issue and look forward to addressing it.
