I too live in San Antonio and have had my belongings thrown onto the street based on a wrongful foreclosure that even the judicial system here won't respond to. I have filed complaints to the Texas Attorney General's office, FTC, HUD, and Fannie Mae and no one seems to be interested enough to investigate the wrongful acts these business men are allowed to make money by doing. I have filed many lawsuits, paid many dollars to several attorneys and still can not find one Judge in Bexar County to listen to a valid complaint. Homecomings and Bank One have a system of taking the equity from your home and charging you for it... We have had a pre-approved refinance beginning in 2001 and are told that Homecomings does not have to respond to a payoff request. From my understanding it is a federal respa law that they infact do have to not only respond but respond within a specific time frame. They badger you into owing $ you do not owe and the best part is that it is reporting to the credit bureau as a paid in full as agreed debt. Go figure, I could just go and buy a brand new house and not worry about them, but I think I will pursue a fight! The Wolf & Popper Law Firm in New York have built a great case against this company (who is not responding to them either. Don't depend on only that. The restitution is minimal. You have to band and file your own lawsuit against these criminals and make sure to include your local TV troublshooter on it too. I have a call into them regarding this issue and am planning to sit with them for an interview! These companies have to be made an example of for the public to view. GMAC owns Homecomings Financial... This is no small mom and pop shop... GMAC is responsible for losing quite a bit of $ over other business ventures and have found a way to make up those $ by screwing over hard working homeowners that never signed contracts with them anyway!
