Regarding money owed to me by Fifth Third bank. This issue is years old and I will have to gather the materials to give exact dates and figures. Starting from the beginning I wrote a check from my business account with Key bank in the amount of $1600.00 to myself and deposited it in the Fifth third branch located in the Krogers on Ferguson ave. A few days later I mailed out my house payment and other bills. About six days after this I received a letter from Fifth third informing me that my account was overdrawn. I returned to the branch office and they told me I had a negative balance from overdraft fees charged by Fifth third, two fees per check per day for six days. I believe the fees totaled about $980.00. I was told that I had made no such deposit and was treated like a criminal who was trying to scam the branch office! I went to Key Bank and had them send me my returned check. After about two weeks I went back to fifth third and spent several hours going through garbage bags filled with deposit slips, looking for the lost money. I showed them my returned check with the stamp on the back saying Fifth third for deposit only and my deposit slip. I had to send my mortgage via western union (expensive$) I had to pay fees from the companies I had written the checks to. I lost a $60,000 dollar account from my business because I didn't have the money to purchase equipment to do the job. This was a terrible hardship for a two year old business to go through (we were doing well until this happened). I took over three months to get the $1600.00 dollars back in my account, and I never got the overdraft fees etc refunded!

I did not get compensated for time, lost business, lost western union fees, damage to my credit and the sever emotional stress this caused (at one point I actually threw up I was so upset). My business was devastated by this as I ran on a very tight budget, and I had to close shortly after! I did get a written apology sent to my mortgage co. But the branch office said it was not there fault and refused to refund the fees saying I had to have the main office refund my money. When I left fifth third for the last time I gave the manager my cut up credit card and told her to fix this and send me the remaining amount. I expected to receive about $1000.00 after paying off the balance on my card. I never received my money back and now they are demanding $1400.00. From me! This better not hurt my credit rating again. There is a lot more to this case than I can write here. I may start a web site about this, if I had had the money at the time I would have taken legal action against Fifth Third.
