Complaint narrative commissioner of banks

I have a repayment agreement to stop a foreclosure in 2004 (see enclosed) Within the original agreement were the 2003 (1207.54) and 2004 (1151.01) taxes for the home.

This May 12 I received a letter stating the repayment plan has been broken as a result of non - payment The payment was sent through Western Union on May 7 but was not posted to the account.

I contract Homecoming (Erick) and explained the payment was send through Western Union on May 07. He requested a copy of receipt and Erick said he would accept that and stop the new foreclosure on May 19th.

Erick called back needing to talk to me, he left a voice mail at 3:00pm on the 20th of May. I called him back 3 times only to reach hi voice mail with no return call on the 20th. I called 7 times on May 23rd to only reach voice mail.

Finally Erick reached me on May 24th at 10:25 after 3 more time to his voice mail. At that time Erick tells me that I need a new agreement because the 2004 taxes had not been included with the first agreement. I tried to explain that it was included and that I was not going to pay it twice.

He told me that he would not accept any more payments without a new agreement being signed to increase my payment to include the 2004 taxes. (New payment would be 1298.32 that a 95.91 increase) I called Erick back on May 25th after looking over my copies of the original agreement (see enclosed) I tried to explain to brake down.

Per the agreement: the total for 5 payments; late fees; attorney's fees; fee bills; corporate advances; equal 7,646.08. On the schedule of payment shows a payment due on 9/2/05 for a total of 10,699.60 to be added back to the unpaid balance to bringing the account current. I was told per Alex Waller and the per the agreement the 10,6996.60 included the 2003 and 2004 taxes.

Again why am I paying for the 2004 taxes in a new escort account, pre Erick. All that was question one.

Now to question # 2... The taxes were a total of 2358.55 there a difference of 694.97 why? What was this for?

Question # 3... If I'm making monthly payment why are the payments still being reported as a negative.
Negative credit reporting will continue as our loan remain delinquent. Also late payment fees are being changed each month per the original, why if I'm making a monthly payment.

Proposed resolution... That Homecoming would continue with original agreement about the payments and the tax amount. That Homecoming would report to the credit bureau that current payments were made on time the past 10 months and in the fortune. That any incorrect amount be correct and credited
