Midland Mortgage Company, mortgage loan servicer of MidFirst Bank, in collusion with other entities, engaged in illegal foreclosure actions against my home.
I know that some posters who use a single identifying letter to identify themselves (though not "X" or "Z", for say Zorro) appear to be employed by this group for the purpose of undermining their victims' credibility online. This site probably does a very good job of ensuring that people are writing from the locations they claim, and people who appear to be MidFirst/Midland employees, whether they claim to be ex-employees or employees of some unnamed oversight agency, have so far happened to be writing from their headquarters state of Oklahoma. Because of the need to fend off such professional harassment, by people who appear to be paid to do this for a living while the rest of us cannot work full-time on defending ourselves, I am going to budget my energy by communicating what happened in my case in installments, with updates and responses.
I completely relate to Steven of Yalaha, FL. Another way that mortgage companies profit by foreclosing (unjust enrichment, for which there is in theory legal recourse) is through false accounting practices that enable them to foreclose in the first place, in cases where foreclosure is against the law, were the law enforced.
In my case there was a lot of equity, and the mortgage would soon have been paid off. I fulfilled my responsibilities and went further, for example by making overpayments that were supposed to be applied to the principal but were instead pocketed. But MidFirst/Midland was determined to take as much home equity as possible, so they manufactured grounds for foreclosure, for example by pocketing payments instead of crediting them to the mortgage account, then claiming that the payments were not made, and then proceeding to foreclosure.
It was proven that the allegedly unmade payments were in fact made, but no one held MidFirst/Midland accountable to transfer the previously missing money from their pocket to the mortgage account. They made off with all sorts of fees, including hundreds of dollars that they represented as having been paid to the Public Trustee, while the Public Trustee's office acknowledged that they "did not receive a penny" of what was therefore falsely represented as an expense of MidFirst/Midland.
There is a one-year waiting period required by statute here in Colorado to re-initiate foreclosure. This statute is enforced better than some others, so MidFirst/Midland initiated another foreclosure, once again without actual grounds, exactly one year later.
This time, rather than manufacturing grounds, their main strategy was to do whatever they could to prevent me from finding out that they were taking foreclosure action against my home. In addition to somehow being allowed by the court not to name me a party to the foreclosure hearing, suddenly my mail was being tampered with and my computer started getting deliberately attacked. And yes, Julie and company, I have proof that the attack was coming from the MidFirst/Midland group.
After an unusually high number of transfers from one judge to the next (according to a clerk of the court), they finally got a judge to provide their rubber stamp, despite my having submitted proof that I was not even provided the legally required notice and summons, much less any other due process requirements, such as grounds with which to foreclose in the first place.
While this is an Outrageous and Popular Ripoff (from the usacomplaints.com categories), the media has been so silent on this type and source of fraudulent activity that many would probably guess it to be an unusual ripoff. The status of this series of events is that I have just initiated a federal lawsuit in the U.S. District Court in Colorado, and I was compelled to file pro se because of MidFirst/Midland's interference with the attorneys I have consulted, such as a sudden conflict of interest. I am therefore seeking legal representation and want to establish contact with homeowners who have been similarly situated, anywhere but especially if present or presentable in Colorado.
