Owners name is Jim non-delivery of goods, item was out of stock asked for refund of $80 plus dollars, no replies

I placed an order with this company, was emailed that the item was out of stock, he asked if I would take something different than what was ordered. I said no, please refund my card, he replied at first, now it has been over a month no recent replies or emails and no refund of $80 plus dollars. I can prove this with my card account statement, lack of verified shipping or delivery, and with emails
