Network International Inc. Have knowingly misrepresented Heavy Railroad Equipment sold by them at auction. I have first hand documented proof of a 1000 horsepower Locomotive being auctioned off as a newer 1200 horsepower unit. This Locomotive ended up being sold by Network International to an unsuspecting and innocent customer.
Though Network International was warned in writing more than once regarding the blatant error days before the closing of the sale... They did not correct the listing description. They were once again made aware of another Locomotive that was not as described. (wrong model and engine)
They then refused to cancel the sale after the auction closed... Even though they admitted in writing that the listing was "completely wrong". Their response was to refer to the disclaimer... Though I'm not sure how you can simply disclaim the act of gross negligence.
Such willful and wanton conduct of this nature generally renders such provisions as void.
Network International Inc is one of the largest Heavy Equipment auction companies in the U.S.A... And yet they are not required to be licensed. Because they do their business online... They do not have to adhere to the strict Code of Conduct or the Rules of Ethics that are enforced by the Texas Department of Licensing and Regulation.
This type of fraud has cost innocent victims 10's of thousands of dollars.
