I was contacted by Dorcy Law, the business for J Randy Dorcy a California attorney, Bar Number 170620, around April. They mailed out a letter offering loan modification services (loan mod's). I had attempted this before directly with our lender and was declined.
After attempting to research them online and finding very little, I called and spoke with one of his agents, Earl.in speaking with Earl, he expressed that he thought our case was a slam dunk, and that they would be able to potentially save us several hundred dollars a month on our mortgage. I told him we had initially been declined because we were not late on our mortgage payments, and he expressed that he thought they would be able to get us a modification, and that we were an ideal candidate. He mailed a contract which stated that their services would cost $3500 but the fee was fully refundable if they were unsuccessful in getting us a modification.
I promptly sent them all of the requested documentation, and waited to hear back from them. I received a few follow up emails requesting information, and they did contact our lender attempting to get us a modification. About 2 months later our lender called me again and said that they were declining us again for the same reason, that we were not behind on our payments. I told them all of the things Earl had communicated to me, expecting that we would be able to get a modification. I was told there was nothing that could be done because we didn't qualify for the modification. One of the qualifications, I was told, is that we had to be at least 90 days past due. I called Dorcy law and spoke with another agent, Kimberlie, and was told this was common and that they would continue to work on our case. A month later they had made no progress, so I considered their efforts unsuccessful and requested a refund.
I spoke with Earl again, and he said I could expect to see the refund within about a week. That was in August.2 weeks later I had heard nothing so I sent several more emails, and put in several other phone calls to various phone numbers, including one that was an answering machine directly for Mr. Dorcy. I was finally told that my case had been turned over to the attorney for processing, and that I should have a refund soon. This continued for several months, until about January. For 6 months, I requested a refund I was contractually owed, and was told it was on the way.
I put in countless calls to Mr. Dorcy, and never received any response from him. He is by far the most dishonest, unethical person I have ever done business with.in my opinion he prey's on people that are financially hurting and in need of loan modification services, making them think he can better their situation. Then, if unsuccessful, he ignores requests for refunds, at least he did mine. Every time I managed to get ahold of someone at his office, I was told he was out of the office or in court, and that he would get back with me soon. His receptionist promised to "personally deliver the message" several times, yet I heard nothing.
I finally looked up the method in which to file a formal complaint with the California State Bar against him (just google that if you want to do the same thing), since he had ignored at least 40 phone calls. I prepared a complaint, which had to be mailed in to the Bar, and got ready to send it. Before I mailed it, I sent an email directly to him, instead of the reps I had been working with, informing Mr. Dorcy that I had a formal complaint prepared and ready to go, and that if I did not have a refund within 24 hours I would mail in a formal complaint.
I wasn't expecting any response, but within about 15 minutes I had an email promising a refund within 3 days if I would wait to mail in my complaint. 3 days came and went with no refund. I sent several other emails back to that same email address asking what was going on. Finally I again gave an ultimatum that if he did not get me the refund immediately, I would mail in the complaint. Again he sent me a rather quick response claiming that he had not received a check he was supposed to have, and hadn't been able to send my refund, but that if I would wait he would get me the refund soon.
Since his first promise to send that refund within 3 days, it has been about 10 weeks and I am still no closer to getting my refund. This man has been very dishonest and deceptive with me, and in my opinion has done everything in his power to delay and avoid giving the contractually owed refund.in one of the few responses he sent me, he told me that I had a right to file a complaint, and that he would then begin the dispute process. I took this as a veiled threat to drag out my refund even longer if I did file the complaint.
If you have had a similar experience, I encourage you to post a complaint against Mr. Dorcy on here and on other similar websites, and especially take a few minutes to mail in a formal complaint to the California Bar. If an attorney gets enough complaints like this, the state may well revoke his license to practice law, which in my opinion he deserves if he is unwilling to honor his contracts. I think that someone like this should not be allowed to offer any kind of services and have the state back him. My next step will be to file a lawsuit against him for breach of contract.
If you are looking for any help from an attorney, I would encourage you to stay far away from J Randy Dorcy and Dorcy Law. I can only speak to my experience, but if I have had this bad of an experience with something this straightforward and simple, I can only imagine what other experiences would be like. I can't say that this was a scam since his agents did contact our lender and at least attempt the offered services. But so far, I have definitely been ripped off.
