Rip off, taking tarp money and then not following the guidelines of the program

This is the letter we most recently sent to our beloved loan servicer (wells fargo) that acts on behalf of our wonderful lender (bank of america).

Attn: prime interest mortgage

We are writing you today, August 3 in regards to our home loan with Wells Fargo (loan no xxxxx1398). On 07/03/09 we were told by one of your representatives we were denied for the HAMP program because our request would be outside of our investor guidelines (per your letter dated 07/03/09). On this same day, I had happened to call in and was told the news over the phone (before the letter arrived) and I was told we were denied because we were not 90 days delinquent on our loan.

First I'd like to thank your company as it took your company three months to let us know we were not 90 days delinquent on our loan. We called a minimum of 3 times a week from the time we first submitted paperwork 04/12/09. All in all we submitted paperwork a total of three times (04/12/09,04/29/09 and then again on 06/13/09). Immediately after we received the GREAT news, we were informed you wanted to help us by KICKING US out of our home prematurely by doing a pre-foreclosure sale and or a deed in lieu of foreclosure.in fact, you immediately sent us to this department and were in the process of assigning us to a short sale realtor - NICE. Isn't the HAMP program supposed to help home owners in imminent danger of losing their home STAY in their home as opposed to being kicked out of their home before any payments are even missed? Why should I be shocked that a large corporation like yours is not doing what they said they would do?

We recently began speaking with a HOPE counselor and our case was once again opened up. The outcome this time. We were denied because our request would be OUTSIDE OUR INVESTOR GUIDELINES. This time however, we were told we couldn't be helped because we were running a $2,000.00/mo deficit. Can you tell me how the intelligent people in your department determined this? I'd like to see the calculation on paper. I would also like to know why it would be a surprise to your department that someone would be running a deficit, ISN'T THIS WHY PEOPLE ARE APPLYING, because they are in IMMINENT DANGER OF LOSING THEIR HOME? I don't think I would be applying for help if I was positive at the end of the day. YOUR ANSWERS DO NOT MAKE ANY SENSE.

This whole process has been a ridiculous joke with your company. Why pretend you are going to help if you aren't, you could save yourselves a lot of time and money and you wouldn't be pissing off so many customers that thought they might have a chance to get some assistance. Wells fargo and bank of america are liars. Give the taxpayers back their money.
