On January 20 I received a call from my aunt in New York saying that a man by the name of Mr. Kirby was repeatedly calling her home number, a place I haven't lived in over 5 years. Even after telling them that no one by my name lives there they still continued to call. I then tried contacting the phone number that they gave her and but every time I would call it sounded like someone would pick up and not say anything. After trying to call them several times, I gave up thinking that it was just s scam.

On March 10 I happened to look at my credit report and noticed that there was a collection on there from a place called Sentry Recovery and Collection. It was a collection from my old apartments in Las Vegas with a total amount due of $3450.08. It also had the same number that I had tried repeatedly tried to call nearly 2 months ago with no luck. I immediately tried calling again and this time I actually got through to someone. I spoke with Mr. Kirby and he stated that if I didn't pay this debt right now that it would go to court. I told him that I didn't have that much money to pay it and if we could set some kind of payment plan up. He then put me on hold for several minutes saying that he would have to call the attorney and see if he would agree to a payment plan. When he finally came back he said that the only way the attorney would agree to a payment plan is if I paid them at least $785 right now. I asked if he could please send me some kind of statement stating how much I owed so that I would know that this was actually a legitimate company but he refused. I agreed to pay the $785 plus a $15 fee to take my payment over the phone with my checking account.

A few weeks later I received the payment agreement in the mail stating that I was to make a payment of $75 on the 5th and 20th of every month and if I defaulted that $863 in attorney's fees would be added on to my balance. I promptly signed it and sent it back. I then continued making payments for $75 as agreed, one on April 10th, April 26th and one on May 6th. When I tried to make my next payment on May 20th, they informed me that my check from April 26th had bounced and that my account was now in default. I asked if I could just make 2 payments right now and he said that it was too late that it was already with the courts and he couldn't talk to me about how to resolve this because his computer was down and I would have to call him back the following day.

By this time Mr. Kirby had disappeared and now a man by the name of Mr. Allen was in charge of my account. When I called the following day he informed me that I had to come into the office immediately to sign some more papers so I wouldn't get sued. I told him that since I now live in Reno I would not be able to that. He said that since he was in good mood that day, he would do me a favor and mail me a stipulation for me to sign saving me the $863 in attorneys fees. That was only if I made a payment of $150 right then. I authorized him to take the payment out of my checking account. He also asked me where I worked so that they wouldn't come after my paycheck.

Weeks went by and I never received the new agreement he said he would mail nor did the payment for $150 ever come out of my checking account. I then called them again wanting to find out why the payment never came out of my account and con Mr. Allen was conveniently out of the office every time I called. After calling 5 or 6 times trying to get a hold of him I was extremely aggravated. Every time I called they would pretend they didn't know me and didn't recall any of our pervious conversations. After being extremely irate with his secretary, Mr. Allen finally called me back later that day. He said that there was some kind of problem with the back that my last payment hadn't come out. I told him that I was trying to pay this debt back and they were making it nearly impossible for me to do so. He then said that he didn't care whether I paid it or not and that unless I apologized for being rude to his secretary that he was going to garnish my wages. He then added that I need to look in the mirror because I was being stupid, that I was never to call this number again and then hung up on me.

Nearly a month later on June 26th, the check for $150 came out of my back account. A week after that on July 3rd I received my pay check with $237 garnished from it. I then received a writ of execution in the mail in favor of the collection agency dated May 19th. So even though they had a court order to garnish my wages they still continued taking money out of my back account. Because my last payment of $150 was after the court order it is not included in the payments that I already made on the writ of execution. I never got anything in the mail saying I was being sued nor I was given a chance to defend myself. I have proof of all the payments I made to them and I should not have to pay an extra $863 in attorneys fees since I was continually making payments to them. This company is extremely deceitful and manipulating in the way they do business and took advantage of me because I didn't know any better. My paychecks being garnish is causing an extreme hardship on me because I can no longer can afford to pay all of my bills or buy groceries. I would appreciate any help or advice that you can offer me.
