IN Oct I moved to Kennesaw where then Cobb emc / now Cobb energy, was the only Electrical company available to my address.in 2004 due to loose of a job, I got behind one month on my electrical bill.
Cobb Emc sent me a letter telling me that they were going to charge me 100 dollar additional deposit for being late. Adding 100 dollars was added to my bill made it even harder to pay the full bill so I paid for the previous month.
The following month I was charged an additional 100 dollars to my bill. I then paid the full bill but was charged again another 100 dollar deposit.
They did this for a total of 500 dollars.in 2004 I called EMC about these charges and was told the max they could charge was 500 dollars. I was also told when I went to pay my bill in person after all the deposits had my bill over 500 dollars. Late 2004 I received 100 dollars back.
It has been 5 years since they collected the 400 dollars and Cobb Energy is holding this money. There isn't another electric company to compete with them so in their monopoly they could get away with these charges resulting in million of dollars for Cobb Energy and if we want electricity we had no choice but to conform.
Even though they told that they would not take more than 500 dollars, their paperwork says it can't be more than 200 dollars deposit. Also the paper work says the deposit is a percentage of your average bill. It was confirmed by Cobb Energy that this percentage was not based on the total bill but for each billing charge. My average bill was no more than 98 dollars.
I have tried to get my deposit back but they say you have to have no late's for a full year to get any of it back. With the unstable job I had it was hard to go that long without one late.
I have all my bill with all supporting documents dating back to 2003. I had an attorney look at them. They too could not see where they justifiably charged me a 400 dollar deposit. They just needed more people to come forward with this same issue to have a class action suite. I was not sure of how to find out who had the same complaint. Because of statue of limitation I need to find others ASAP.
